TRADUCTIONS EN CONTEXTE

10. a) Sauf convention contraire des parties dans un délai de cinq jours ouvrables à compter de la date de sélection des arbitres, le groupe spécial d'arbitrage a le mandat ci-après: "examiner, à la lumière des dispositions pertinentes de l'accord d'association, la question visée dans la demande d'établissement du groupe spécial d'arbitrage, se prononcer sur la compatibilité de la mesure en cause avec les dispositions visées à l'article 2 du protocole et statuer conformément à l'article 8 du protocole sur le règlement des différends".
10 (a) Unless the Parties agree otherwise, within five working days of the date of the selection of the arbitrators, the terms of reference of the arbitration panel shall be: "to examine, in the light of the relevant provisions of the Association Agreement, the matter referred to in the request for establishment of the arbitration panel, to rule on the compatibility of the measure in question with the provisions referred to in Article 2 of the Protocol and to make a ruling in accordance with Article 8 of the Protocol on Dispute Settlement".

14. Only arbitrators may take part in the deliberations of the arbitration panel, but the arbitration panel may permit its assistants to be present at its deliberations.

b) Sauf convention contraire des parties, celles-ci se réunissent avec le groupe spécial d'arbitrage dans les sept jours ouvrables suivant l'établissement de ce dernier, afin de déterminer les sujets que les parties ou le groupe spécial d'arbitrage jugent appropriés, y compris la rémunération et les dépenses des arbitres, qui doivent être conformes aux normes de l'OMC.
(b) Unless the Parties agree otherwise, they shall meet the arbitration panel within seven working days of its establishment in order to determine such matters that the Parties or the arbitration panel deem appropriate, including the remuneration and expenses to be paid to the arbitrators, which must be in accordance with WTO standards.

32. No arbitrator may discuss an aspect of the subject matter of the proceeding with a Party or both Parties in the absence of the other arbitrators.

b) "candidat" la personne dont le nom figure sur la liste d'arbitres visée à l'article 185, paragraphe 2 du présent accord et qui est susceptible d'être désignée comme membre d'un groupe spécial d'arbitrage au sens de l'article 185, paragraphe 3 du présent accord.
(b) "candidate" means an individual whose name is on the list of arbitrators referred to in of Article 185(2) of this Agreement and who is under consideration for appointment as a member of an arbitration panel under Article 185(3) of this Agreement.

13. Seuls les arbitres peuvent participer aux délibérations du groupe spécial d'arbitrage.
13. Only arbitrators may take part in the deliberations of the arbitration panel but the arbitration panel may permit their assistants to be present during such deliberations.

Le projet de loi C-4 donne le pouvoir à un groupe spécial arbitral réuni aux termes, selon le cas, de l'article 24 de l'Accord sur l'environnement, ou de l'article 29 de l'Accord sur le travail, de forcer l'un ou l'autre des partenaires à appliquer ses propres lois en matière d'environnement et de travail.
Bill C-4 enables a panel, an arbitration panel convened under article 24 of the environmental co-operation agreement or article 29 of the labor co-operation agreement to require either partner to effectively enforce its own environmental or labour laws.
