45. prend acte également de deux initiatives importantes: la création de la plateforme pour une bonne gouvernance fiscale, qui réunit autour de la même table plusieurs parties prenantes dans le but de créer le consensus en matière de lutte contre l'évasion fiscale, en particulier dans un contexte international, et le forum conjoint sur les prix de transfert, qui publie un certain nombre de lignes directrices sur les questions techniques liées à l'établissement des prix de transfert; souligne qu'à ce jour, ces deux organes ont apporté leur contribution, sous forme de modestes corrections, au cadre régissant la fiscalité des entreprises; regrette que les lignes directrices élaborées par le forum conjoint sur les prix de transfert n'aient pas permis, jusqu'à présent, d'apporter une solution suffisante au problème de l'évasion fiscale; déplore fortement que la composition du forum conjoint sur les prix de transfert soit toujours déséquilibrée, malgré une modification récente; s'oppose, en outre, au fait que des fiscalistes puissent contribuer aux travaux sur les lignes directrices relatives à l'établissement des prix de transfert, tout en fournissant par ailleurs des conseils à leurs clients sur des stratégies d'optimisation fiscale agressive fondées sur l'établissement des prix de transfert, et dès lors se trouver en position de conflit d'intérêts;
45. Notes also the efforts made through the creation of the Platform for Tax Good Governance, which brings various stakeholders around the same table with the aim of creating consensus around the issue of tax avoidance, in particular in an international context, and the Joint Transfer Pricing Forum, which issues a number of guidelines on the technical issues surrounding transfer pricing; stresses that, to date, these bodies have contributed to making limited corrections to the corporate tax framework; regrets that the guidelines issued by the Joint Transfer Pricing Forum so far have not sufficiently tackled the issue of tax avoidance; deplores the fact that the composition of the Joint Transfer Pricing Forum, despite a recent update of its membership, is still unbalanced; objects, moreover, to the fact that tax experts contribute to the work on guidelines on transfer pricing while, at the same time, they may be advising their clients on aggressive tax planning strategies based on transfer pricing, and thus be in a position of conflict of interest;

approfondir la coopération entre l'UE et l'Ukraine sur les questions relatives à l'environnement et renforcer la capacité de l'Ukraine à faire face aux questions relatives à la qualité de l'air et de l'eau, à la gestion des déchets, à la protection de la nature et aux contaminations radioactives, questions dont certaines ont de fortes implications transfrontalières; apporter une aide technique et financière à l'Ukraine afin qu'elle se rapproche progressivement de l'acquis environnemental de l'UE et de normes environnementales fondées sur le droit international environnemental, y compris la Convention d'Espoo de 1991 sur l'évaluation de l'impact sur l'environnement dans un contexte transfrontière et la Convention de Berne de 1979 sur la conservation de la vie sauvage et du milieu naturel de l'Europe; envisager la création d'un mécanisme entièrement opérationnel et viable afin de promouvoir la prise de conscience et la protection de l'environnement en constituant un forum de coopération entre les gouvernements, la société civile/les ONG et le secteur privé dans les pays voisins de l'UE à l'Est;
deepen cooperation between the EU and Ukraine on environmental issues and strengthen Ukraine's capacity to tackle matters relating to air and water quality, waste management, nature protection and radiation contamination, some of which have strong cross-border implications; provide technical and financial assistance to Ukraine in the process of gradual approximation to the EU environmental acquis and environmental standards based on international environmental law, including the 1991 Espoo Convention on Environmental Impact Assessment in a Transboundary Context and the 1979 Bern Convention on the Conservation of European Wildlife and Natural Habitats; envisage the setting-up of a fully operational and sustainable mechanism to promote environmental awareness and protection by providing a forum for cooperation between governments, civil society/NGOs and the private sector in the EU's eastern neighbourhood;

Is concerned that, with 60% of the world's remaining tigers being in India, the planned but delayed all-India tiger census may show a drop in numbers to a critical low of 1 500 tigers in the country; acknowledges that the value of the illegal trade in wild animal species is estimated to be second only to the international trade in illegal drugs and that the levels of exploitation and trade in some species, such as tigers, are so high that their populations are being severely depleted; requires improved monitoring of imports of wildlife specimens and wildlife products so that the Convention on Trade in Endangered Species (CITES) is upheld, and enforcement improved in order to save endangered species from the threat of extinction; calls on the EU offer cooperation and technical assistance to India to help maintain its biodiversity and tackle the illegal trade in wildlife; calls for the issue of tiger protection in general, and combating the trade in tiger skin, bones and body parts in particular, including through customs cooperation, to be placed on the agenda of the next meeting of the EU-India Environment Forum;

7. SOULIGNE l'importance d'une coopération et d'un échange d'informations au niveau international afin d'éviter la duplication des efforts et de faciliter l'harmonisation des mesures de réglementation et PREND SOIGNEUSEMENT NOTE des travaux accomplis ou en cours de réalisation, notamment dans le cadre du Forum intergouvernemental sur la sécurité chimique, de l'Organisation de coopération et de développement économiques (OCDE), de l'accord de coopération scientifique et technique entre l'UE et les États-Unis, du Protocole de la CEE des Nations unies relatif aux polluants organiques persistants (POP), des négociations sur l'instrument global du PNUE relatif aux polluants organiques persistants et de la Convention pour la protection du milieu marin de l'Atlantique du Nord-Est (OSPAR) ;
7. STRESSES the importance of international cooperation and information exchange, in order to avoid duplication of efforts and facilitate the harmonisation of regulatory actions and TAKES CAREFUL NOTE of the work done or being done, namely within the Intergovernmental Forum on Chemical Safety (IFCS), the Organisation for Economic Cooperation and Development (OECD), the EU-US Science and Technology Cooperation Agreement, the UNECE Protocol on Persistent Organic Pollutants (POPs), the negotiations on the UNEP Global Persistent Organic Pollutants instrument and the Convention for the Protection of the Marine Environment of the North-East Atlantic (OSPAR);

Lignes d'action possibles : - favoriser la création d'un marché du crédit et d'un marché mobilier intégré et fiable pour les entreprises et les institutions, qui opèrent sur le marché financier international, et l'intégration progressive des systèmes bancaires euro-méditerranéens ; - l'implication des entreprises et des banques européennes dans l'élaboration des projets, le financement et le monitorage, relatifs à la réalisation des principaux réseaux infrastructurels, à réaliser dans les pays méditerranéens ; - la diffusion de techniques d'intervention en "financement de projet" ; - les activités de formation et d'assistance technique visant à l'introduction de nouveaux concepts dans l'évaluation et le développement de projets (comme les sous-traitances, les investissements immatériels pour des activités d'amélioration de la qualité, les adoptions de stratégies de marketing-oriented) ; - l'activité de formation et de stages de fonctionnaires de banque auprès d'institutions financières communautaires spécialisées dans le soutien au développement des P.M.E. ANNEXE II FORUM INDUSTRIEL EURO-MEDITERRANEEN (Malte, 13 et 14 mai 1996) DECLARATION FINALE Les représentants des organisations d'entreprises euro-méditerranéennes, réunis à Malte les 13 et 14 Mai 1996, ont discuté, à l'occasion du "Forum industriel euro-méditeranéen", de certains aspects du partenariat économique et industriel essentiels au développement économique et social de la zone sud de la Méditerranée.
Possible lines of action: - promoting the establishment of an integrated securities and credit market that business and institutions operating on the international finance market can rely upon, and the gradual integration of Euro-Mediterranean banking systems; - involvement of business and European banks in the planning, financing and monitoring of major infrastructure networks to be created in Mediterranean countries; - dissemination of project-financing techniques; - training and technical assistance activities to introduce new project evaluation and development concepts (such as subcontracted production, intangible investments for quality improvement, the adoption of market-oriented strategies); - arrangement of training and courses for banking officials to be held in Community financial institutions specializing in SME development support. ANNEX II EURO-MEDITERRANEAN INDUSTRIAL FORUM (Malta, 13 and 14 May 1996) FINAL DECLARATION Representatives of Industrial Organizations met in Malta on 13 and 14 May 1996 on the occasion of the "Euro-Mediterranean Industrial Forum". They discussed those aspects of an economic and industrial partnership which will be decisive in shaping the economic and social development of the South Mediterranean region.
