Article 19(1)(a) of Commission Regulation (EEC) No 2220/85 of 22 July 1985 laying down common detailed rules for the application of the system of securities for agricultural products, as amended by Commission Regulation (EC) No 3403/93 of 10 December 1993, must be interpreted as meaning that the guarantee furnished by an exporter to ensure the repayment of the advance received by way of export refund must not be considered to be extinguished even where it is established that the exporter submitted the acceptance of the export declaration, proof that the goods left the customs territory of the European Union within a maximum period of 60 days after that acceptance, and the proof of clearance of those products through customs in the importing third country, if the other conditions for the grant of the refund, in particular the condition of sound and fair marketable quality of the products exported, provided for in Article 13 of Commission Regulation (EEC) No 3665/87 of 27 November 1987 laying down common detailed rules for the application of the system of export refunds on agricultural products, as amended by Commission Regulation (EC) No 1829/94 of 26 July 1994, are not satisfied.

(4) Pour garantir l'uniformité des conditions de mise en œuvre du présent règlement, il convient de conférer des compétences d'exécution à la Commission en ce qui concerne: l'adoption dans les six mois de l'entrée en vigueur du présent règlement d'un programme de travail relatif au à la conception et au déploiement des systèmes électroniques; les décisions autorisant un ou plusieurs États membres à utiliser des moyens d'échange et de stockage de données autres que les techniques électroniques de traitement des données; les décisions autorisant les États membres à effectuer des essais de simplification de l'application de la législation douanière faisant appel à des techniques électroniques de traitement des données; les décisions imposant à un État membre de prendre, de suspendre, d'annuler, de modifier ou de révoquer une décision; les critères et les normes communs en matière de risque, ainsi que les mesures de contrôle et les domaines de contrôle prioritaires; la gestion des plafonds applicables aux contingents tarifaires et des plafonds tarifaires, ainsi que la gestion de la surveillance de la mise en libre pratique ou de l'exportation des marchandises; la détermination du classement tarifaire des marchandises; la dérogation temporaire aux règles d'origine préférentielle pour les marchandises bénéficiant de mesures préférentielles adoptées unilatéralement par l'Union; la détermination de l'origine des marchandises; les interdictions temporaires touchant le recours aux garanties globales; l'assistance mutuelle entre autorités douanières dans les cas où il y a naissance d'une dette douanière; les décisions relatives au remboursement ou à la remise d'un montant de droits à l'importation ou à l'exportation; les heures d'ouverture officielles des bureaux de douane; la détermination de la sous-position tarifaire des marchandises soumises au droit à l'importation ou à l'exportation le plus élevé lorsqu'un même envoi est composé de marchandises relevant de s ...
(4) In order to ensure uniform conditions for implementation of this Regulation, implementing powers should be conferred on the Commission in respect of: the adoption within six months of the entry into force of this Regulation of a work programme relating to the development and deployment of the electronic systems; decisions allowing one or several Member States to use means of exchange and storage of data other than electronic data-processing techniques; decisions authorising Member States to test simplifications in the application of the customs legislation using electronic data-processing techniques; decisions requesting Member States to take, suspend, annul, amend or revoke a decision; common risk criteria and standards, control measures and priority control areas; the management of the tariff quota and tariff ceilings and the management of the surveillance of the release for free circulation or export of goods; the determination of the tariff classification of goods; the temporary derogation from the rules on preferential origin of goods benefiting from preferential measures adopted unilaterally by the Union; the determination of the origin of goods; the temporary prohibitions relating to the use of comprehensive guarantees; the mutual assistance between the customs authorities in case of incurrence of a customs debt; decisions on repayment or remission of an amount of import or export duty; the official opening hours of customs offices; the determination of the tariff subheading of the goods which are subject to the highest rate of import or export duty where a consignment is made of goods falling under different tariff subheadings; Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers.

Should it appear that the sub-ceiling for Asia is insufficient for financing operations in the region and especially in the five countries that would become eligible for EIB loans under Community guarantee, or should any other sub-ceiling appear not adapted to the specific needs in some other developing regions, the mid-term review of the Council Decision could create an opportunity for adjustment.

This general authorisation can only be used when the initial export has taken place under a Community General Export Authorisation or an initial export authorisation has been granted by the competent authorities of the Member State where the original exporter was established for the export of the items which have subsequently been re-imported into the Community Custom territory for the purposes of repair or replacement under warranty, as defined below.

They seek to increase the protection offered by the definition of low value shipments, and to protect against the selling price being artificially lowered in order to meet the conditions of the 'low value shipments' export authorisation (AM 17), to introduce an ex-ante notification and registration requirement to the Member States and the Commission, thus raising transparency (AM 24, 34, 42, and 45), to introduce additional safeguards for export authorisation (AM 26 to 33, 41, and 44) in relation to Annexes IId (Temporary Export for Exhibition or Fair), IIf (Telecommunications), and IIg (Chemicals), to prohibit GEAs of items that could be used for launching of cyber-attacks, or of any other means of politically motivated hacking to conduct sabotage or espionage, to deface web pages, or to use denial-of-service attacks to take web pages down (AM 38), and to prohibit GEAs to items that can be used by governments or business to violate fundamental human rights, as defined under the European Social Charter signed at Turin on 18 October 1961 and in the 1989 Community Charter of the Fundamental Social Rights of Workers, and the Charter of Fundamental Rights of the European Union which was proclaimed at Strasbourg on 12 December 2007 by the European Parliament, the Council and the Commission, to which Article 6 of the Treaty on European Union refers to (AM 39).

At that time it was also considered necessary to provide for the possibility that when products covered by a common market organisation and imported from third countries could, under certain conditions, be brought under a customs warehousing or a free zone procedure, whereby collection of the import duties was suspended, to introduce a provision made for payment of an amount equal to the export refund as soon as Community products or goods intended for export were brought under such a procedure.
