a) lorsque le testament d'un ancien combattant désigne un exécuteur testamentaire et que le tribunal de juridiction compétente nomme ce dernier, ou lorsqu'un administrateur, ou un administrateur avec testament annexé, a été nommé par le tribunal de juridiction compétente, ou lorsque l'exécuteur testamentaire nommé dans un testament non homologué établit à la satisfaction du préposé aux successions que le testament est le dernier testament du défunt et qu'il en a assumé l'exécution, ou qu'il en est devenu exécuteur de son tort ou qu'il est prêt à en assumer l'exécution, le préposé aux successions peut faire remettre à cet exécuteur testamentaire ou administrateur, pour distribution, l'actif net de la succession militaire en sa possession;
(a) where, in a Will of a veteran, an executor has been named and such nominee has been appointed executor by a court of competent jurisdiction, or where an administrator or an administrator with Will annexed has been appointed by a court of competent jurisdiction, or where the executor named in an unprobated Will has proved to the satisfaction of the Estates Officer that such Will is the last Will of the deceased and that he has assumed the executorship or become an executor de son tort or is willing to accept the executorship of such Will, the Estates Officer may cause to be delivered over to such executor or administrator, for distribution, the net assets of the service estate in his possession;
