La position à prendre au nom de l'Union européenne au sein du comité mixte institué par l'article 12 de l'accord entre l'Union européenne et la République d'Azerbaïdjan visant à faciliter la délivrance de visas, en ce qui concerne l'adoption de lignes directrices communes pour la mise en œuvre dudit accord, est fondée sur le projet de décision du comité mixte joint à la présente décision.
The position to be taken on behalf of the European Union within the Joint Committee set up by Article 12 of the Agreement between the European Union and the Republic of Azerbaijan on the facilitation of the issuance of visas, with regard to the adoption of common guidelines for the implementation of that Agreement, shall be based on the draft Decision of the Joint Committee attached to this Decision.

All Annexes are subject to adoption by the Council before being adopted by the Joint Committee, but will, regrettably, not be subject to Parliament's consent, because the Treaty provisions of Article 218(9) (TFEU) do not provide for any involvement of Parliament in the decisions of the Joint Committee.

Whenever a new measure with EEA relevance is adopted, the EFTA Secretariat drafts a Joint Committee decision to amend the annex of the respective agreement, which is normally adopted later by the Joint Committee.

4. Pour les décisions relatives à des questions relevant de la compétence des États membres, la position à adopter par l’Union et ses États membres au sein du comité mixte est arrêtée par le Conseil statuant à l’unanimité sur proposition de la Commission ou de tout État membre, sauf si un État membre a fait savoir au secrétariat général du Conseil, dans un délai d’un mois à compter de l’adoption de cette position, qu’il ne peut accepter la décision du comité mixte qu’avec l’accord de ses organes législatifs, notamment en raison d’une réserve d’examen parlementaire.
4. For decisions concerning matters that fall within the competence of the Member States, the position to be taken by the Union and its Member States within the Joint Committee shall be adopted by the Council, acting by unanimity on a proposal from the Commission or from any Member State, unless a Member State has informed the General Secretariat of the Council within one month of the adoption of that position that it can only consent to the decision to be taken by the Joint Committee with the agreement of its legislative bodies, notably due to a parliamentary scrutiny reserve.
