It is settled case law that the scope of a decision must be determined not only by reference to the actual wording of that decision, but also by taking into account the aid scheme as described by the Member State (35). In Kahla Thüringen, the Court held that a request for additional information of the Commission that aims at clarifying the scope of application of an aid scheme, and the reply given by the Member States to that request, must be considered an indivisible part to the aid scheme (36).
