1. Une fois que la Commission a ouvert la procédure de retrait temporaire du bénéfice des préférences tarifaires, elle constitue un dossier qui contient tous les documents pertinents lui permettant de tirer ses conclusions, y compris les informations fournies par le pays bénéficiaire du SPG, du SPG + ou de l’initiative TSA concerné (ci-après le «pays bénéficiaire»), les informations soumises par les tiers qui se sont fait connaître conformément à l’article 1er, paragraphe 2, et toute autre information pertinente qu’elle a obtenue.
1. Where the Commission has initiated the procedure for the temporary withdrawal of the tariff preferences it shall establish a constituted file. A constituted file shall contain the documents which are relevant for drawing conclusions, including, information provided by the concerned GSP beneficiary country, GSP + beneficiary country or EBA beneficiary country (the ‘beneficiary country’), information submitted by third parties which have come forward in accordance with Article 1(2) and any relevant information obtained by the Commission.

In the present case, it is clear from the documents in the case that the action before the Tribunal was brought within the time-limit of three months laid down in the Staff Regulations, extended on account of distance by a single period of 10 days from the date on which the applicant received notification that the complaint had been rejected; that the applicant challenges the decision regarding his grading on his appointment as a temporary agent, which he regards as adversely affecting him, and that he has a legal interest in bringing proceedings since he is challenging an administrative decision of individual application producing binding legal effects that directly and immediately affect his interests.
