Notes that international agreements have binding force and an impact on EU legislation, and points to the need for negotiations to be transparent throughout the entire process, implying that the institutions should publish the negotiating mandate conferred on the EU negotiator without undermining the EU’s negotiating position; considers that documents related to international agreements should be public in principle, without prejudice to legitimate exceptions and without undermining the trust necessary between the parties concerned to achieve effective negotiations; regrets that the Commission and the Council routinely classify all documents relating to negotiations, thereby limiting citizens’ access to information; maintains that the public should be given access to all relevant negotiating documents, including those already agreed on, with the exception of those which are considered sensitive, with a clear justification on a case-by-case basis, in accordance with Article 9 of Regulation (EC) No 1049/2001.

Urges each of the Contracting Parties to the United Nations Convention on the Prevention and Punishment of the Crime of Genocide, of 1948, and to other international agreements for the prevention and punishment of war crimes, crimes against humanity and genocide, and in particular the competent authorities of countries – and their nationals – which are in any way supporting, cooperating in or funding, or are complicit in, these crimes, to wholly fulfil their legal obligations under the convention and such other international agreements;

Stresses that documents relating to international agreements, including documents adopted by, or submitted to, any bodies which have the task of implementing or monitoring the application of such agreements, should be disclosed to the public, as they are not categorically excluded from public access, and that access to them should be refused only when there is real harm to international relations, and taking into account Article 4(4) of Regulation (EC) No 1049/2001 on consultations with a third party; emphasises that since international agreements have binding effects, a public interest test should be introduced with regard to the exception; points out that Parliament, which is elected by the EU's citizens, is entrusted by the Treaties with an institutional role in representing the public interest; expresses its firm determination to make sure that the new institutional prerogatives assigned to Parliament by the Lisbon Treaty (Article 218 TFEU) in the field of international agreements are fully respected, and that no bilateral agreements with third countries may prohibit this;

17. Reiterates its position that, in accordance with Article 218(6) of the TFEU, the opinion/consent of the European Parliament is required for all international agreements, including those related mainly to CFSP, with the sole exception of those related exclusively to CFSP: in accordance with Article 218(10) of the TFEU, full information must be provided to Parliament at the initial, negotiating and final stages of the procedure leading to the conclusion of international agreements; expects the VP/HR to provide all relevant information about the negotiations throughout the procedure, including negotiating directives and draft negotiating texts, and recalls that in the declaration on political accountability the VP/HR committed herself to applying the provisions of the Framework Agreement on international agreements with regard to confidential CFSP documents; calls for the establishment of an efficient modus operandi that combines respect for Parliament's prerogatives with the necessary degree of confidentiality; believes that a comprehensive agreement involving all the institutions and covering all EU bodies is required in order to regulate access to confidential documents by Members of Parliament;
