1. 1. Manufacturers shall demonstrate that all new vehicles sold, registered or put into service within the Community, all new engines sold or put into service within the Community and all new replacement pollution control devices requiring type-approval pursuant to Articles 8 and 9, which are sold or put into service within the Community, are type-approved in accordance with this Regulation and its implementing measures.

9. Sans préjudice des paragraphes 1 à 8 du présent article et sous réserve de l’entrée en vigueur des mesures adoptées au titre de l’article 4, paragraphe 6, si un constructeur en fait la demande, les autorités nationales ne refusent pas d’accorder, pour des motifs liés à la protection des piétons, la réception CE par type ou la réception nationale par type d’un nouveau type de véhicule et n’interdisent pas l’immatriculation, la vente ou la mise en circulation d’un véhicule neuf, si le véhicule concerné répond aux dispositions techniques définies à l’annexe I, section 3 ou 4.
9. Without prejudice to paragraphs 1 to 8 of this Article and subject to the entry into force of the measures adopted pursuant to Article 4(6), if a manufacturer so requests, the national authorities shall not, on grounds relating to pedestrian protection, refuse to grant EC type-approval or national type-approval for a new type of vehicle or prohibit the registration, sale or entry into service of a new vehicle, where the vehicle concerned complies with the technical provisions set out in Sections 3 or 4 of Annex I.

L'essai de durabilité des dispositifs de maîtrise de la pollution entrepris pour la réception couvre une période de 160 000 km. Pour se conformer à cet essai de durabilité, le constructeur doit avoir la possibilité d'avoir recours au banc d'essai de vieillissement, sous réserve des mesures de mise en œuvre visées au paragraphe 4.
Durability testing of pollution control devices undertaken for type approval shall cover 160 000 km. To comply with this durability test, the manufacturers should have the possibility to make use of test bench ageing, subject to the implementing measures referred to in paragraph 4.
