IN-CONTEXT TRANSLATIONS

27. invite les États membres de l'Union européenne à signer et ratifier toutes les conventions essentielles des Nations unies et du Conseil de l'Europe en matière de droits de l'homme, ainsi que leurs protocoles facultatifs, en particulier la convention internationale de 1990 sur la protection des droits de tous les travailleurs migrants et des membres de leur famille, la convention internationale pour la protection de toutes les personnes contre les disparitions forcées, la déclaration des Nations unies sur les droits des peuples autochtones du 13 septembre 2007, la déclaration de 1998 de l'Organisation international du travail relative aux principes et droits fondamentaux au travail, la convention-cadre du Conseil de l'Europe pour la protection des minorités nationales, la charte européenne des langues régionales ou minoritaires, le protocole facultatif se rapportant au pacte international sur les droits économiques, sociaux et culturels, les protocoles facultatifs à la convention sur les droits de l'enfant et la convention des Nations unies relative aux droits des personnes handicapées; souligne avec force que le protocole facultatif annexé à la convention européenne des droits de l'homme devrait être considéré comme une partie intégrante de cette dernière et se prononce en faveur de l'adhésion simultanée à la convention et au protocole ;
27. Calls on the EU Member States to sign up to, and ratify, all core UN and Council of Europe human rights conventions and the optional protocols thereto, in particular the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, the International Convention for the Protection of All Persons from Enforced Disappearance, the United Nations Declaration on the Rights of Indigenous Peoples of 13 September 2007, the 1998 ILO Declaration on Fundamental Principles and Rights at Work, the Council of Europe's framework convention for the protection of national minorities, the European Charter for Regional or Minority languages, the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights, the Optional Protocols to the Convention on the Rights of the Child and the United Nations Convention on the Rights of Persons with Disabilities; insists that the Optional Protocol to the Convention should be regarded as an integral part thereof, and calls for simultaneous accession to the latter (Convention and Protocol) ;

In this connection, safeguards for the independence of broadcasting are of key importance, in line with the general principle of freedom of expression as embodied in Article 11 of the Charter of Fundamental Rights of the European Union (9) and Article 10 of the European Convention of Human Rights, a general principle of law the respect of which is ensured by the European Courts (10).

H. whereas on 10 November Matyas Eörsi and Kastriot Islami, co-rapporteurs for Georgia of the Monitoring Committee of the Parliamentary Assembly of the Council of Europe (PACE) reminded the Georgian authorities to strictly abide by the principles of the rule of law in all their actions and to comply with the provisions of the European Convention on Human Rights, especially those relating to freedom of expression, information and association, pointing out that police violence against peaceful demonstrations, shutting down private broadcasting stations or clamping down on information dissemination was unacceptable under any circumstances in a democratic system, and stressing that 'the freedom of the media has to be guaranteed without restrictions.

6. enjoint les autorités nationales compétentes, et les institutions en particulier, à respecter leurs engagements visant à mettre en œuvre et achever, conformément au contenu et au calendrier adoptés, les réformes de la radiodiffusion publique, de la police, de la défense et des services secrets, et à adopter et mettre en œuvre les dispositions nécessaires, ainsi qu'à garantir une coopération pleine et entière avec le TPIY tout en veillant à ce que la Constitution soit compatible avec la Convention européenne des droits de l'homme;

Warns the country's competent authorities and institutions in particular to honour their commitments to implement and complete, in accordance with the agreed contents and schedule, the public broadcasting, police, defence and intelligence reforms and to adopt and implement all necessary laws, as well as ensure full cooperation with the ICTY and compatibility of the Constitution with the European Convention on Human Rights;

F. considérant que la prochaine conférence régionale des radiocommunications de 2006 (RRC06) a été convoquée pour revoir l'accord régional pour la zone européenne de radiodiffusion (Stockholm, 1961), en vue d'harmoniser le volet de cet accord relatif à l'utilisation des bandes de fréquence 174-230 MHz et 470-862 MHz dans le service de radiodiffusion,
F. whereas the forthcoming Regional Radiocommunication Conference 2006 (RRC06) has been convened to revise the Regional Agreement for the European Broadcasting Area, Stockholm, 1961, with a view to harmonising that part of the Agreement which relates to the use of the frequency bands 174-230 MHz and 470-862 MHz in the broadcasting service,

I believe that now, in this policy of forward movement, the inclusion in Article 6(2) of the Treaty on European Union is very important, as there is no sense – and I do not wish to be inconsistent – in the European Union deciding not to provide a legal basis in the Treaty for the Union to be able to adhere to the European Convention on Human Rights and, at the same time, talking in the same paragraph about the interpretation of fundamental rights based on this same European Convention for the Protection of Human Rights.

(3) considérant que le traité prévoit la libre circulation de tous les services fournis normalement contre rémunération; que ce droit, appliqué aux services de radiodiffusion et à ceux de la société de l'information, est aussi une manifestation spécifique, en droit communautaire, d'un principe plus général, à savoir la liberté d'expression telle qu'elle est consacrée par l'article 10 de la convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales; que cet article reconnaît explicitement la liberté des citoyens de recevoir et de communiquer des informations sans considération de frontières et que toute restriction de cette liberté doit tenir dûment compte des autres intérêts légitimes dignes d'être juridiquement protégés;
(3) Whereas the Treaty provides for the free movement of all services which are normally provided for remuneration; whereas this right, as applied to broadcasting and information society services, is also a specific manifestation in Community law of a more general principle, namely freedom of expression as enshrined in Article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms; whereas that Article explicitly recognizes the right of citizens to receive and impart information regardless of frontiers and whereas any restriction of that right must be based on due consideration of other legitimate interests deserving of legal protection;
