Welcomes the fact that since 2012, twelve trade union organisations have received their licences; recalls that administrative manoeuvres must not be designed to withhold legal status from independent unions that attempt to operate outside the existing trade union organisation; calls on the Algerian authorities to allow new trade unions to register legally and to comply with the conventions implemented by the ILO that have been ratified by Algeria, particularly Convention No 87 on Freedom of Association and Protection of the Right to Organise and Convention No 98 on the Right to Organise and Collective Bargaining;

During border surveillance operations at sea, Member States should respect their respective obligations under international law, in particular the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air, the United Nations Convention relating to the Status of Refugees, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the International Covenant on Civil and Political Rights, the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the United Nations Convention on the Rights of the Child and other relevant international instruments.

The implementation of this Regulation does not affect the division of competence between the Union and the Member States or the obligations of Member States under the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air, the Convention Relating to the Status of Refugees, the Convention for the Protection of Human Rights and Fundamental Freedoms and other relevant international instruments.

ACKNOWLEDGING the necessity of observing human rights and freedoms, and emphasising that this Agreement shall be without prejudice to the rights and obligations of the Community, the Member States of the European Union and Ukraine arising from the Universal Declaration of Human Rights of 10 December 1948 and from international law, in particular, from the European Convention of 4 November 1950 for the Protection of Human Rights and Fundamental Freedoms, the Convention of 28 July 1951 and the Protocol of 31 January 1967 on the Status of Refugees, the international Covenant on Civil and Political Rights of 19 December 1966 and international instruments on extradition,

Les États membres devraient faire en sorte que les actions entreprises dans le cadre du Fonds respectent les obligations découlant des droits fondamentaux, établis notamment par la Convention européenne de sauvegarde des Droits de l'Homme et des libertés fondamentales (la Convention européenne des Droits de l'Homme), la Charte des droits fondamentaux de l'Union européenne, la Convention de Genève du 28 juillet 1951 relative au statut des réfugiés, telle que la complète le protocole de New York du 31 janvier 1967, ainsi que, le cas échéant, les autres instruments internationaux pertinents tels que la Convention des Nations unies de 1989 relative aux droits de l'enfant.
Member States should ensure that actions under the Fund respect the obligations derived from fundamental rights, laid down in particular in the European Convention for the Protection of Human Rights and Fundamental Freedoms (the European Convention on Human Rights), the Charter of Fundamental Rights of the European Union, the Geneva Convention relating to the Status of Refugees of 28 July 1951 as supplemented by the New York Protocol of 31 January 1967, and other relevant international instruments, such as the 1989 United Nations Convention on the Rights of the Child, where applicable.

Article 4a International Conventions Any measures taken by Member States under this Directive must be taken with due respect for the rights of refugees and applicants for asylum within the framework of the Geneva Convention and according to the guidelines set out in the UNHCR Handbook on refugees, Article 3 of the European Convention on the Protection of Human Rights and Fundamental Freedoms, Article 3 of the UN Convention against Torture, Article 7 of the International Covenant on Civil and Political Rights or other international agreements.

5. La présente directive s'applique sans préjudice des obligations découlant des articles 32 et 33 de la Convention de Genève du 28 juillet 1951 relative au statut des réfugiés, modifiée par le Protocole de New York du 31 janvier 1967 et des articles 3 et 8 de la Convention de sauvegarde des droits de l'homme et des libertés fondamentales du 4 novembre 1950 , ainsi que de l'article 3 de la Convention des Nations unies contre la torture et autres peines ou traitements cruels, inhumains ou dégradants .
5. This Directive shall apply without prejudice to the obligations imposed by Articles 32 and 33 of the Geneva Convention of 28 July 1951 on the Status of Refugees, as amended by the New York Protocol of 31 January 1967, and Articles 3 and 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and Article 3 of the United Nations Convention Against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment.
