Attendu que, par le décret C.P. 1997-496 du 8 avril 1997, le gouverneur en conseil a déclaré que, conformément à l’Article XVI de la Convention sur la sécurité sociale entre le gouvernement du Canada et le gouvernement du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, signée le 16 janvier 1997, la Convention entrera en vigueur le premier jour du quatrième mois suivant celui où chaque Partie aura reçu de l’autre Partie une notification écrite indiquant qu’elle s’est conformée à toutes les exigences législatives relatives à l’entrée en vigueur de la Convention;
Whereas, by Order in Council P.C. 1997-496 of April 8, 1997, the Governor in Council declared that, in accordance with Article XVI of the Convention on Social Security between the Government of Canada and the Government of the United Kingdom of Great Britain and Northern Ireland, signed on January 16, 1997, the Convention shall enter into force on the first day of the fourth month following the month in which each Party shall have received written notification from the other Party that it has complied with all statutory requirements for the entry into force of the Convention;

Accordingly, hazardous chemicals, whether in the form of substances on their own or in mixtures or in articles, which have been banned or severely restricted by the Union as plant protection products, as other forms of pesticides, or as industrial chemicals for use by professional users or by the public, should be subject to export notification rules similar to those applicable to such chemicals when they are banned or severely restricted within either or both of the use categories laid down in the Convention, namely as pesticides or chemicals for industrial use.

This Convention - which aims at setting out the obligations of Parties to assess the environmental impact of certain activities at an early stage of planning and which imposes on States the general obligation regarding notification and consultation on all major projects that are likely to have a significant adverse environmental impact across borders - was signed by the Community and its Member States on 26 February 1991 and approved by the Community on 27 June 1997.

Outre l'application des principes établis par la convention, la proposition de règlement prévoit en particulier: des renforcements portant sur la notification d'exportation concernant un plus grand nombre de produits; l'extension de la PIC aux produits qui sont interdits ou sévèrement réglementés dans la Communauté; la possibilité d'interdire l'exportation de certains produits chimiques interdits dans la Communauté; et un étiquetage adéquat de tous les produits exportés de la Communauté.
In addition to applying the principles established by the Convention, the proposal for a Regulation provides in particular for: extending the scope of export notification to a wider range of chemicals, extension of the PIC to chemicals that are banned or severely regulated in the Community, the possibility of banning the export of certain chemical products banned in the Community, and appropriate labelling of all chemicals exported from the Community.
