1. La BCN concernée ou, lorsque les données de groupe sont déclarées à la BCE en vertu de l'article 3 bis, paragraphe 5, la BCE, après consultation de la BCN concernée, peut octroyer des dérogations aux obligations de déclaration prévues par le présent règlement si les agents déclarants effectifs déclarent les mêmes données en application a) du règlement (UE) no 1071/2013 de la Banque centrale européenne (BCE/2013/33) (*1); b) du règlement (UE) no 1073/2013 (BCE/2013/38); c) du règlement (UE) no 1075/2013 (BCE/2013/40); ou d) du règlement (UE) no 1374/2014 (BCE/2014/50); ou si la BCN concernée ou, le cas échéant, la BCE, peut établir les mêmes données par d'autres moyens, conformément aux normes statistiques minimales précisées à l'annexe III.
1. The relevant NCB or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements under this Regulation if the actual reporting agents report the same data under: (a) Regulation (EU) No 1071/2013 of the European Central Bank (ECB/2013/33) (*1); (b) Regulation (EU) No 1073/2013 (ECB/2013/38); (c) Regulation (EU) No 1075/2013 (ECB/2013/40); or (d) Regulation (EU) No 1374/2014 (ECB/2014/50); or if the relevant NCB or the ECB, as applicable, are able to derive the same data by other means, in accordance with the minimum statistical standards specified in Annex III.

3. 3. For a period of two years from the first reporting in accordance with Article 10b(2), the relevant NCB, or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements to group data reporting agents with respect to the reporting on entity-by-entity basis set out in Chapter 2 of Annex I for entities resident outside the Union provided that the relevant NCB or the ECB, as applicable, are able to derive the information in Chapter 2 of Annex I for the entities resident outside the Union as a whole’.

2. The relevant NCB or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements to group data reporting agents with respect to the flag “issuer is part of the reporting group (prudential scope)”, on a security-by-security basis, as set out in Article 3a(3), provided that the relevant NCB or the ECB, as applicable, is able to derive these data from data collected from other sources.

34. Believes that the responsibility of the European Central Bank (ECB) to report on monetary policy is now greater, since the ECB is recognised as an institution of the European Union; welcomes the fact that several provisions of the Statute of the European System of Central Banks (ESCB) and of the ECB can be modified after consulting Parliament in accordance with Article 40.2 of that Statute; affirms that this does not constitute an encroachment on the independence of the ECB in the field of monetary policy or the priorities set out in the Treaty;

15. Art. 107 [129], paragraph 3, TFEU: amendment of certain provisions of the Statute of the ESCB – ordinary legislative procedure (Commission proposal with consultation of the ECB or ECB recommendation with consultation of the Commission) (Art. 107.5 TEC – in the case of the Commission proposal, the Council acts unanimously after consulting the ECB; in all cases the EP is required to give its assent; in the case of a recommendation from the ECB, the Council acts by qualified majority after consulting the Commission)

Conformément à l'article 129, paragraphe 4, du traité sur le fonctionnement de l'Union européenne le Conseil, soit sur proposition de la Commission et après consultation du Parlement européen et de la BCE, soit sur recommandation de la BCE et après consultation du Parlement européen et de la Commission, adopte les dispositions visées aux articles 4, 5.4, 19.2, 20, 28.1, 29.2, 30.4 et 34.3 des présents statuts.
In accordance with Article 129(4) of the Treaty on the Functioning of the European Union, the Council, either on a proposal from the Commission and after consulting the European Parliament and the ECB or on a recommendation from the ECB and after consulting the European Parliament and the Commission, shall adopt the provisions referred to in Articles 4, 5.4, 19.2, 20, 28.1, 29.2, 30.4 and 34.3 of this Statute.

40.1. Conformément à l'article 129, paragraphe 3, du traité sur le fonctionnement de l'Union européenne, les articles 5.1, 5.2, 5.3, 17, 18, 19.1, 22, 23, 24, 26, 32.2, 32.3, 32.4 et 32.6, l'article 33.1, point a), et l'article 36 des présents statuts peuvent être révisés par le Parlement européen et le Conseil, statuant conformément à la procédure législative ordinaire soit sur recommandation de la BCE, après consultation de la Commission, soit sur proposition de la Commission et après consultation de la BCE.
40.1. In accordance with Article 129(3) of the Treaty on the Functioning of the European Union, Articles 5.1, 5.2, 5.3, 17, 18, 19.1, 22, 23, 24, 26, 32.2, 32.3, 32.4, 32.6, 33.1(a) and 36 of this Statute may be amended by the European Parliament and the Council, acting in accordance with the ordinary legislative procedure either on a recommendation from the ECB and after consulting the Commission, or on a proposal from the Commission and after consulting the ECB.
