En dépit du fait que les contrats avec OSE et ISAP ne portent pas sur la construction navale mais sur la construction de matériel roulant, la Commission utilisera comme mesure de comparaison le pourcentage de 0,8 % étant donné que la construction de matériel roulant demeurait une activité d’importance particulièrement restreinte pour HSY alors que le principal volume de ses activités et, dès lors, le principal risque que représentait la société en cause portait sur la construction et la réparation navales.
Even if the contracts with OSE and ISAP do not concern shipbuilding but the construction of rolling stock, the Commission will use 0,8 % as benchmark since the construction of rolling stock remained a marginal activity for HSY and most of the activities of HSY, and therefore most of the risk of HSY, concerned ship building and ship repair.

Plus précisément, si HSY avait fait faillite, la construction du matériel roulant aurait été interrompue, aucun matériel n’aurait été livré à OSE et il n’aurait pas été possible de demander de paiement à OSE, en vertu de l’accord précité (133).
Indeed, if HSY had gone bankrupt, the construction of the rolling stock would have stopped, no delivery would have been made to OSE and no payment could be requested from OSE under that Agreement (133).

(11) Railway undertakings and station managers should take into account the needs of disabled persons and persons with reduced mobility, through compliance with the TSI of persons with reduced mobility, so as to ensure that, in accordance with Community public procurement rules, all buildings and rolling stock are made accessible through the progressive elimination of physical obstacles and functional hindrances when acquiring new material or carrying out construction or major renovation work.

(10 bis) L’entreprise ferroviaire et le gestionnaire des gares doivent tenir compte des besoins des personnes handicapées ou à mobilité réduite, en se conformant à la spécification technique d'interopérabilité pour les personnes à mobilité réduite, en vue de garantir que, conformément aux règles communautaires en vigueur pour les marchés publics, toutes les installations et tout le matériel roulant soient accessibles, et ce en éliminant progressivement les obstacles physiques et fonctionnels lors de l’achat de nouveau matériel, lors de nouvelles constructions et de rénovations importantes.

(22) Les exigences liées aux services de transport de voyageurs et celles liées au fret peuvent souvent être incompatibles. Les exigences liées au transport de voyageurs peuvent être à l'origine d'un réseau dont la construction et l'entretien sont plus coûteux qu'un réseau conçu exclusivement pour le fret. L'écart croissant en termes de vitesse entre le matériel roulant réservé au fret et le matériel roulant destiné au transport de voyageurs risque d'aggraver l'opposition entre ces deux types de trafic.
(22) The requirements for passenger services may often conflict with the requirements for freight; the requirements for passenger services may result in a network which is more costly to build and maintain than one designed solely for freight; the increasing speed differential between freight and passenger rolling stock can lead to an exacerbation of the conflict between these two types of traffic.
