D. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, members of the National Council (Nationalrat) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

(21) Complémentairement à la libération en temps utile et bénéfique pour la concurrence des bandes de fréquences de 880 à 915 MHz et de 925 à 960 MHz (la «bande de 900 MHz»), conformément à la directive 2009/114/CE du Parlement européen et du Conseil , la bande de fréquences de 790 à 862 MHz (la «bande de 800 MHz») peut être utilisée de manière optimale pour la couverture de zones étendues par des services à haut débit sans fil.
(21) In addition to a timely and pro-competitive freeing up of the 880-915 MHz and 925-960 MHz frequency bands (the ‘900 MHz band’) in accordance with Directive 2009/114/EC of the European Parliament and of the Council , the 790–862 MHz band (the ‘800 MHz band’) can be used in an optimal way for the coverage of large areas by wireless broadband services.

La décision 2003/106/CE du Conseil du 19 décembre 2002 concernant l’approbation, au nom de la Communauté européenne, de la convention de Rotterdam sur la procédure de consentement préalable en connaissance de cause applicable à certains produits chimiques et pesticides dangereux qui font l’objet d’un commerce international (2) autorisait le président du Conseil à désigner la ou les personnes habilitées à déposer l’instrument d’approbation au nom de la Communauté auprès du secrétaire général des Nations unies, conformément à l’article 25, paragraphe 1, de ladite convention, ci-après dénommée la «convention de Rotterdam» (3).
Council Decision 2003/106/EC of 19 December 2002 concerning the approval, on behalf of the European Community, of the Rotterdam Convention on the Prior Informed Consent Procedure for certain hazardous chemicals and pesticides in international trade (2) authorised the President of the Council to designate the person or persons empowered to deposit the instrument of approval on behalf of the Community with the Secretary-General of the United Nations, in accordance with Article 25(1) of that Convention, (hereinafter referred to as ‘the Rotterdam Convention’) (3).

(21) considérant que, selon la définition donnée à l'origine dans la directive 87/372/CEE du Conseil du 25 juin 1987 concernant les bandes de fréquence à réserver pour l'introduction coordonnée de communications mobiles terrestres publiques cellulaires numériques paneuropéennes dans la Communauté (12), les systèmes de communications mobiles cellulaires numériques de la deuxième génération fonctionnent dans la bande des 900 MHz; que le DCS-1800 doit être considéré comme appartenant à la famille des GSM et à cette deuxième génération; que la Communauté doit s'appuyer sur le succès rencontré par la génération actuelle des produits de la technologie du mobile numérique, notamment le GSM, tant en Europe que dans le reste du monde, en tenant compte de l'interfonctionnement entre l'UMTS et ces systèmes de deuxième génération; que, conformément au droit communautaire, il ne doit pas y avoir de discriminations entre les opérateurs de GSM et les nouveaux entrants sur les marchés de l'UMTS; que l'UMTS devrait se développer dans un environnement intégré sans solution de continuité, permettant une itinérance totale avec les réseaux GSM et entre les composantes terrestre et satellitaire des réseaux UMTS, ce qui rendra probablement nécessaires des terminaux hybrides, tels que les terminaux bi-modes et bi-bandes GSM/UMTS et les terminaux terrestre/satellite;
(21) Whereas the second generation cellular digital mobile communications systems were originally defined in Council Directive 87/372/EEC of 25 June 1987 on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community (12) as operating in the 900 MHz bands; whereas DCS-1800 has to be considered as part of the GSM family and of such second generation; whereas the Community should build on the success of the current generation of mobile digital technology including GSM both in Europe and in the world, taking into consideration interworking between UMTS and second-generation systems; whereas there should be, pursuant to Community law, no discrimination between GSM operators and new entrants in UMTS markets; whereas UMTS should develop in one seamless environment including full roaming with GSM as well as between the terrestrial and satellite components of UMTS networks, which is likely to make hybrid terminals such as dual mode/band GSM/UMTS terminals and terrestrial/satellite terminals necessary;

(c) which are owned to an extent of at least 50 % by nationals of EC Member States or of the West Bank and Gaza Strip, or by a company with its head office in one of these States, of which the manager or managers, Chairman of the Board of Directors or the Supervisory Board, and the majority of the members of such boards are nationals of EC Member States or of the West Bank and Gaza Strip and of which, in addition, in the case of partnerships or limited companies, at least half the capital belongs to those States or to public bodies or nationals of the said States;
