The provisions of this Regulation shall, in the field of transport by rail, road and inland waterway, apply both to all agreements, decisions and concerted practices which have as their object or effect the fixing of transport rates and conditions, the limitation or control of the supply of transport, the sharing of transport markets, the application of technical improvements or technical cooperation, or the joint financing or acquisition of transport equipment or supplies where such operations are directly related to the provision of transport services and are necessary for the joint operation of services by a grouping within the meaning of Article 3 of road or inland waterway transport undertakings, and to the abuse of a dominant position on the transport market.

Regulation 11 concerning the abolition of discrimination in transport rates and conditions requires from transporters of goods by rail, road or inland waterway within the Community to provide information on tariffs, agreements, price deals and transport conditions on a transport document that they need to carry with them when transporting the goods.

− The next item is the report (A6-0513) by Mr Costa, on behalf of the Committee on Transport and Tourism, on the proposal for a regulation of the European Parliament and of the Council amending Regulation No 11 concerning the abolition of discrimination in transport rates and conditions, in implementation of Article 79(3) of the Treaty establishing the European Economic Community, and Regulation (EC) No 852/2004 of the European Parliament and the Council on the hygiene of foodstuffs – Transport aspects [COM(2007)0090 - C6-0086/2007 - 2007/0037A(COD)].

1. Le transporteur a le droit, en cas de présomption grave de non-respect des conditions de transport, de vérifier si les objets (colis à main, bagages, véhicules, y compris leur chargement) et animaux transportés répondent aux conditions de transport lorsque les lois et prescriptions de l’État où la vérification doit avoir lieu ne l’interdisent pas.

When there is good reason to suspect a failure to observe the conditions of carriage, the carrier shall have the right to examine whether the articles (hand luggage, registered luggage, vehicles including their loading) and animals carried comply with the conditions of carriage, unless the laws and prescriptions of the State in which the examination would take place prohibit such examination.

Cependant, la durée énoncée au point 1 ne doit pas augmenter de plus de 50 %;

Where animals of the species referred to in paragraph 1 are intended for breeding and sporting purposes (and are registered as such), travelling time of more than eight hours, or a distance of more than 500 km, is permitted, subject to a maximum travelling time of 48 hours and the granting of prior authorisation, provided that existing standards are applied so that all animals have access to adequate lying area with clean litter and have individual access to sufficient fresh water and feed; in addition, the means of transport should have mechanical ventilation (irrespective of engine type), and the temperature inside the means of transport must not fall below 5°C or exceed 30°C; for areas where there are no, or hardly any, slaughterhouses within a radius of 500 km, the Commission may, on the basis of specific geographical circumstances, grant temporary dispensation as regards the duration specified in paragraph 1 and the conditions in which transport takes place; the duration specified in paragraph 1 may not, however, be increased by more than 50%;
