2. 2. The Rotterdam Convention on the Prior Informed Consent procedure for certain hazardous chemicals and pesticides in international trade includes, both as regards the aims pursued and its contents, two indissociably linked components, neither of which can be regarded as secondary or indirect as compared with the other, one falling within the scope of the common commercial policy and the other within that of protection of human health and the environment.

La Commission définit ensuite le type de décisions visées par sa communication: il s'agit des décisions relevant du droit pénal (ensemble de règles prévoyant des sanctions ou des mesures de réinsertion) et ayant un caractère final (c'est-à-dire les décisions des tribunaux et de certaines autorités administratives, les résultats des procédures de médiation et les accords entre les suspects et les ministères publics).
The Commission then defines the type of decisions to which its Communication refers: they are decisions under criminal law (all rules laying down sanctions or measures to rehabilitate offenders) which are final (i.e. decisions by courts and certain administrative tribunals, the outcome of mediation procedures and agreements between suspects and prosecution services).
