(2) Au terme des travaux préparatoires engagés par l'Organisation mondiale de la propriété intellectuelle, avec la participation des États membres parties à l'union de Madrid, des États membres qui ne sont pas parties à l'union de Madrid et de la Communauté européenne, la conférence diplomatique réunie en vue de la conclusion d'un protocole relatif à l'arrangement de Madrid concernant l'enregistrement international des marques a adopté, le 27 juin 1989 à Madrid, le protocole relatif à l'arrangement de Madrid concernant l'enregistrement international des marques (ci-après dénommé "protocole de Madrid").
(2) Following preparations initiated and carried out by the World Intellectual Property Organisation with the participation of the Member States which are members of the Madrid Union, the Member States which are not members of the Madrid Union and the European Community, the Diplomatic Conference for the conclusion of a Protocol relating to the Madrid Agreement concerning the international registration of marks adopted the Protocol relating to the Madrid Agreement concerning the international registration of marks (hereafter referred to as "the Madrid Protocol") on 27 June 1989, at Madrid.

2. La demande de marque nationale ou la désignation d'un État membre partie au protocole de Madrid ou à l'arrangement de Madrid issue de la transformation de la désignation de la Communauté européenne opérée par le biais d'un enregistrement international bénéficie, dans l'État membre concerné, de la date de l'enregistrement international prévue à l'article 3, paragraphe 4, du protocole de Madrid, de la date d'extension à la Communauté européenne en vertu de l'article 3 ter, paragraphe 2, du protocole de Madrid si celle-ci est postérieure à l'enregistrement international ou de la date de priorité de cet enregistrement et, le cas échéant, de l'ancienneté d'une marque de cet État revendiquée conformément à l'article 148.
2. The national trade mark application or the designation of a Member State party to the Madrid Protocol or the Madrid Agreement resulting from the conversion of the designation of the European Community through an international registration shall enjoy, in respect of the Member State concerned, the date of the international registration pursuant to Article 3(4) of the Madrid Protocol or the date of the extension to the European Community pursuant to Article 3ter(2) of the Madrid Protocol if the latter was made subsequently to the international registration, or the date of priority of that registration and, where appropriate, the seniority of a trade mark of that State claimed under Article 148.

(10) La Commission des Communautés européennes devrait être autorisée à représenter la Communauté au sein de l'assemblée de l'union de Madrid après l'adhésion de la Communauté au protocole de Madrid.
(10) The European Commission should be authorised to represent the European Community in the Assembly of the Madrid Union after the accession of the Community to the Madrid Protocol.
