Une marque commerciale qui correspond à l'une des situations visées à l'article 40 du présent règlement et qui a été demandée, enregistrée ou établie par l'usage, si cette possibilité est prévue dans la législation concernée, sur le territoire de la Communauté avant le 4 mai 2002 ou avant la date de dépôt auprès de la Commission de la demande de protection de la mention traditionnelle, peut continuer à être utilisée et renouvelée nonobstant la protection de la mention traditionnelle.
2. A trademark, which corresponds to one of the situations referred to in Article 40 of this Regulation, and which has been applied for, registered or established by use, if that possibility is provided for by the legislation concerned, in the territory of the Community before 4 May 2002 or before the date of submission of the application for protection of the traditional term to the Commission, may continue to be used and renewed notwithstanding the protection of the traditional term.

At present the following Regulations apply: Commission Regulation (EEC) 1696/87 of 10 June 1987 laying down certain detailed rules for the implementation of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution , Commission Regulation (EC) No 804/94 of 11 April 1994 laying down certain detailed rules for the application of Council Regulation (EEC) No 2158/92 as regards forest-fire information systems , Commission Regulation (EC) No 1091/94 of 29 April 1994 laying down certain detailed rules for the implementation of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution , Commission Regulation (EC) No 1727/1999 of 28 July 1999 laying down certain detailed rules for the application of Council Regulation (EEC) No 2158/92 on protection of the Community's forests against fire , Commission Regulation (EC) No 2278/1999 of 21 October 1999 laying down certain detailed rules for the application of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution .

For rural and rural background stations the location shall, where appropriate, be coordinated with the monitoring requirements of Commission Regulation (EC) No 1091/94 of 29 April 1994 laying down certain detailed rules for the implementation of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution .

(6) La Communauté a déjà abordé, dans le cadre du règlement (CEE) n° 3528/86 du Conseil du 17 novembre 1986 relatif à la protection des forêts dans la Communauté contre la pollution atmosphérique(7) et du règlement (CEE) n° 2158/92 du Conseil du 23 juillet 1992 relatif à la protection des forêts dans la Communauté contre les incendies(8), les problèmes posés par deux facteurs qui ont des conséquences néfastes sur les écosystèmes forestiers.
(6) The Community has already addressed two of the causes adversely affecting forest ecosystem conditions by means of Council Regulation (EEC) No 3528/86 of 17 November 1986 on the protection of the Community's forests against atmospheric pollution(7) and Council Regulation (EEC) No 2158/92 of 23 July 1992 on protection of the Community's forests against fire(8).

(b)in the case of products which have been lawfully placed on the market in the Community but which are not referred to in point (a), operators responsible for placing on the market in the Community the products concerned shall, within six months after the date of application of this Regulation, notify the Commission that the products were placed on the market in the Community before the date of application of this Regulation.

By letter of 7 November 2001 the Commission submitted to Parliament, pursuant to Article 251(2) and Article 175(1) of the EC Treaty, the proposal for a European Parliament and Council regulation amending Council Regulation (EEC) No 3528/86 on the protection of the Community’s forests against atmospheric pollution (COM(2001) 634 - 2001/0267 (COD)) and the proposal for a regulation of the European Parliament and of the Council amending Council Regulation (EEC) No 2158/92 on the protection of the Community’s forests against fire (COM(2001) 634 – 2001/0268(COD)).
