TRADUCTIONS EN CONTEXTE

Pour prévenir les menaces pour la santé animale sur son territoire, il est d’une importance capitale pour la Communauté de recueillir, d'analyser et de synthétiser des informations sur la santé animale dans les Balkans, le Caucase et les régions méditerranéennes, surtout concernant les maladies qui se sont propagées à travers les frontières.
Gathering analysing and summarising information on animal health in the Balkans, the Caucasus and the Mediterranean areas, especially as regards diseases which are spread across borders, is of paramount importance for the Community, in order to prevent threats to animal health within its territory.

Il convient par conséquent que la Communauté participe au financement du développement par l’Organisation mondiale de la santé animale (OIE) du système d’information zoosanitaire au cours de la période 2008-2012.
It is therefore appropriate to make a Community financial contribution for the financing of the development of the animal disease information system for the period from 2008 to 2012 by the World Organisation for Animal Health (OIE).

L'article 8 de la directive 2002/99/CE prévoit que, lors de l'établissement des listes de pays tiers ou régions de pays tiers en provenance desquels les importations dans la Communauté de produits d'origine animale déterminés sont autorisées, il est notamment tenu compte de certains éléments tels que l'état sanitaire du cheptel, la régularité, la rapidité et la fiabilité avec lesquelles le pays tiers fournit les informations concernant la présence de maladies infectieuses ou contagieuses des animaux sur son territoire, en particulier l'influenza aviaire et la maladie de Newcastle, et la situation sanitaire générale du pays, dans la mesure où elle est susceptible d'induire un risque pour la santé publique ou animale dans la Communauté.
Article 8 of Directive 2002/99/EC provides that when drawing up lists of third countries or regions of third countries thereof from which imports of specified products of animal origin are permitted into the Community, particular account is to be taken of certain matters, such as the health status of livestock, the regularity, speed and accuracy with which the third country supplies information on the existence of certain infectious or contagious animal diseases in its territory, in particular avian influenza and Newcastle disease and the general health situation in the third country concerned which might pose a risk to public or animal health in the Community.

Il convient de faire observer à ce propos qu'il est stipulé dans le préambule, que la directive est sans préjudice du règlement (CEE) n° 3254/91 du Conseil du 4 novembre 1991 interdisant l'utilisation du piège à mâchoires dans la Communauté et l'introduction dans la Communauté de fourrures et de produits manufacturés de certaines espèces animales sauvages originaires de pays qui utilisent pour leur capture le piège à mâchoires ou des méthodes non conformes aux normes internationales de piégeage sans cruauté.
It may be noted in this connection that it is stated in the preamble that the directive is without prejudice to Council Regulation (EEC) No 3254/91 of 4 November 1991 prohibiting the use of leghold traps in the Community and the introduction into the Community of pelts and manufactured goods of certain wild animal species originating in countries which catch them by means of leghold traps or trapping methods which do not meet international humane trapping standards.

Les produits destinés aux aliments pour animaux ne peuvent entrer, en provenance de pays tiers aux fins de leur utilisation dans la Communauté, être mis en circulation et/ou utilisés dans la Communauté que s'ils sont de qualité saine, loyale et marchande et, par conséquent, lorsqu'ils sont utilisés correctement, ne présentent aucun danger pour la santé humaine, la santé animale ou l'environnement ou ne sont pas susceptibles de nuire à la production animale.
1. Products intended for animal feed may enter for use in the Community from third countries, be put into circulation and/or used in the Community only if they are sound, genuine and of merchantable quality and therefore when correctly used do not represent any danger to human health, animal health or to the environment or could adversely affect livestock production.

Au septième tiret de l'article 8, paragraphe 1, il est précisé que lors de l'établissement des listes, il est notamment tenu compte de "l'état sanitaire du cheptel, des autres animaux domestiques et de la faune sauvage du pays tiers, en accordant une attention particulière aux maladies animales exotiques et à tous les aspects de la situation sanitaire générale du pays, dans la mesure où elle est susceptible d'induire un risque pour la santé publique ou animale dans la Communauté" (C'est nous qui soulignons.)
Indent 7 of Article 8(1) mentions that, when establishing these lists, particular account shall be taken of "the health status of the livestock, other domestic animals and wildlife in the third country, having particular regard to exotic animal diseases and any aspects of the general health situation in the country, which might pose a risk to public or animal health in the Community" (emphasis added).

Le chapitre II réglemente les importations de produits d'origine animale en provenance des pays tiers et énonce en particulier le principe selon lequel les dispositions applicables aux produits d'origine animale en provenance de pays tiers doivent être conformes ou équivalentes aux dispositions en vigueur dans la Communauté.
Chapter II is given over to imports from third countries and, in particular, lays down the principle that products of animal origin imported from third countries must conform to the rules applying in the Community or rules of an equivalent standard.

(7) La présente décision sera réexaminée en fonction de l'évolution du statut zoosanitaire des territoires d'origine et, en particulier, dans le cadre de l'application des accords entre la Communauté et les pays tiers relatifs aux matières visées par la présente décision, notamment en ce qui concerne l'article 5 de l'accord entre la Communauté européenne et le gouvernement du Canada relatif aux mesures sanitaires de protection de la santé publique et animale applicables au commerce d'animaux vivants et de produits animaux et l'article 6 de l'accord entre la Communauté européenne et les États-Unis d'Amérique relatif aux mesures sanitaires de protection de la santé publique et animale applicables au commerce d'animaux vivants et de produits animaux.
(7) This Decision shall be reviewed in the light of developments in the animal health status of the territories of origin and, in particular, in the frame of the application of agreements between the Community and third countries concerning the matters covered by this Decision, notably as concerns Article 5 of the Agreement between the European Community and the Government of Canada on sanitary measures to protect public and animal health in respect of trade in live animals and animal products and Article 6 of the Agreement between the European Community and the United States of America on sanitary measures to protect public and animal health in trade in live animals and animal products.

Pour pallier ces lacunes, la proposition vise à prévoir la possibilité pour des experts de la Commission et des États membres d'opérer des contrôles non seulement dans la Communauté mais aussi dans les pays tiers, notamment suite à l'apparition d'un phénomène susceptible d'influencer négativement la salubrité des aliments pour animaux mis en circulation dans la Communauté ; adopter un régime de sauvegarde et donner à la Commission la possibilité, en cas de nécessité, de dépêcher sur place des experts de la Communauté pour vérifier si la réglementation communautaire est respectée et d'adopter, le cas échéant, les mesures appropriées ; confier à la Commission l'adoption, en plus des programmes généraux déjà prévus par la directive 95/53/CE, de programmes de contrôle coordonnés spécifiques, en cas de contamination inopinée pouvant constituer un danger imminent et grave pour la santé humaine et animale.
In order to offset these omissions, the proposal aims to stipulate that Commission and Member State experts should have the possibility of carrying out inspections not only within the Community but also in third countries, particularly following the emergence of a phenomenon likely to have an adverse effect on the fitness for consumption of animal feeding stuffs marketed within the Community; that a safeguard procedure should be set up and that the Commission should have the opportunity, if necessary, to assign Community experts to the site in order to check whether Community regulations are being observed and to take any appropriate measures necessary; that the Commission should be responsible for adopting specific coordinated inspection programmes, in addition to the general programmes already stipulated by Directive 95/53/EC, in the event of unexpected contamination which may represent an imminent and serious risk to human and animal health.
