Stresses that a new constitution based on provisions promoting a pluralistic, inclusive and tolerant society would underpin the reform process and provide a solid base for fundamental freedoms and the rule of law; commends the work done by the constitutional conciliation committee, which reached consensus on 60 constitutional amendments before being dissolved; reiterates its call for the constitutional reform process to continue and underlines the need for a new constitution to be based on widespread consensus across the political spectrum and in society as a whole; encourages Turkey to consult with the Venice Commission in the framework of the constitutional reform process;

Deplores the impasse reached in the talks between Serbia and Montenegro on the constitutional structure of the country and the establishment of a constitutional commission in charge of drafting the constitutional charter, whose adoption is a matter of the utmost urgency; underlines the importance of political stability and institutional clarification for the preparation of negotiations on a stabilisation and association agreement; believes that the reintegration process can only be a lasting success if the countries concerned move perceptibly closer to the EU in the foreseeable future;

La Cour constitutionnelle allemande a estimé que les dispositions régissant l’accès aux données ainsi que leur utilisation, telles que figurant dans la législation nationale, étaient anticonstitutionnelles[43]. La Cour constitutionnelle roumaine a jugé que la conservation de données était en soi contraire à l’article 8 de la convention de sauvegarde des droits de l'homme et des libertés fondamentales (convention européenne des droits de l’homme) et était donc anticonstitutionnelle[44]. La Commission procède actuellement à l’évaluation de cet instrument et doit présenter son rapport d’évaluation au Parlement européen et au Conseil à la fin 2010.
The German constitutional court found that the rules governing access to and the use of the data, as laid down in national law, were unconstitutional.[43] The Romanian constitutional court found that data retention per se breached Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and was thus unconstitutional.[44] The Commission is currently evaluating this instrument and is to submit its assessment report to the European Parliament and the Council in late 2010.
