1. La Commission présente au Parlement européen, au Conseil et au Comité économique et social, au plus tard le 1er janvier 2009, et par la suite tous les quatre ans, un rapport sur l'application et les effets de la présente directive en accordant une attention particulière à la compétitivité du marché de l'art moderne et contemporain dans la Communauté, notamment en ce qui concerne la situation de la Communauté à l'égard des marchés importants qui n'appliquent pas le droit de suite de l'artiste et le soutien de la création artistique ainsi que les modalités de gestion dans les États membres.
1. The Commission shall submit to the European Parliament, the Council and the Economic and Social Committee not later than 1 January 2009 and every four years thereafter a report on the implementation and the effect of this Directive, paying particular attention to the competitiveness of the market in modern and contemporary art in the Community, especially as regards the position of the Community in relation to relevant markets that do not apply the resale right and the fostering of artistic creativity and the management procedures in the Member States.

2. Le droit visé au paragraphe 1 s'applique à tous les actes de revente dans lesquels interviennent en tant que vendeurs, acheteurs ou intermédiaires des professionnels du marché de l'art, tels les salles de vente, les galeries d'art et, d'une manière générale, tout commerçant d'oeuvres d'art.
2. The right referred to in paragraph 1 shall apply to all acts of resale involving as sellers, buyers or intermediaries art market professionals, such as salesrooms, art galleries and, in general, any dealers in works of art.

The Commission, believing that the attached recommendations on training in cancer adopted by the Advisory Committee on Medical Training, the Advisory Committee on Training in Nursing, and the Advisory Committee on the Training of Dental Practitioners, constitute a good basis for the widest possible discussion in the Member States, makes the following recommendation pursuant to the EEC Treaty, and in particular the second indent of Article 155 thereof:

II. In order to facilitate the mutual recognition of diplomas, certificates and other qualifications between Member States, as provided for in Article 57 of the EEC Treaty, the Council, by successive Decisions, set up the Advisory Committee on Medical Training (1), the Advisory Committee on Training in Nursing (2) and the Advisory Committee on the Training of Dental Practitioners (3).
