IN-CONTEXT TRANSLATIONS

1. Les quantités sur lesquelles portent les demandes de certificats d'importation relevant du contingent portant le numéro d'ordre 09.4308 et visé à l'annexe du règlement d'exécution (UE) 2015/2081, introduites du 4 janvier 2016 au 8 janvier 2016 à 13 heures, heure de Bruxelles, sont affectées d'un coefficient d'attribution de 46,782204 % pour les demandes introduites dans le cadre du contingent tarifaire portant le numéro d'ordre 09.4308.
1. The quantities covered by the applications for import licences under the quota with order number 09.4308 and referred to in the Annex to Implementing Regulation (EU) 2015/2081, lodged from 4 January 2016 to 8 January 2016 at 13.00 (Brussels time), shall be multiplied by an allocation coefficient of 46,782204 % for applications lodged under the tariff quota with order number 09.4308.

The extent to which import licences may be issued should therefore be determined by fixing the allocation coefficient to be applied to the quantities requested under the quota concerned, calculated in accordance with Article 7(2) of Commission Regulation (EC) No 1301/2006 (3).

The issue of licences for quantities requested later than 16 April 2007 at 13:00 (Brussels time) and falling within subquota II as referred to in Regulation (EC) No 2375/2002 has been suspended by Commission Regulation (EC) No 421/2007 of 18 April 2007 fixing the allocation coefficient to be applied to applications for import licences lodged from 9 April 2007 to 16 April 2007 under subquota II in the context of the Community tariff quota opened by Regulation (EC) No 2375/2002 for common wheat of a quality other than high quality (5) .

Where, for one of the subquotas, the result of applying the allocation coefficient would be to allocate licences for less than 20 tonnes per application, the corresponding quantities available shall be awarded by the Member State concerned by drawing lots for licences of 20 tonnes each amongst the applicants who would have been allocated less than 20 tonnes as a result of applying the allocation coefficient.

3. Where licence applications reach or exceed the quantity of one of the delivery obligations by country concerned fixed under Article 12 in the case of ACP/India sugar, or of one of the tariff quotas in the case of other sugars, the Commission shall fix an allocation coefficient in proportion to the quantity available which the Member States shall apply to each application.

(7) Afin de garantir le sérieux des demandes de certificats d'importation, d'empêcher les spéculations et d'assurer au maximum l'utilisation des contingents ouverts, il convient de limiter la quantité de chaque demande à 10 % du contingent concerné, de supprimer la possibilité de renoncer aux certificats si le coefficient d'attribution est inférieur à 0,8, de n'ouvrir les contingents qu'aux opérateurs ayant importé ou exporté les produits faisant l'objet des contingents, de définir des critères d'éligibilité pour demander des certificats en exigeant des documents prouvant la qualité de commerçant de chaque demandeur et la nature régulière de ses activités, ainsi que de limiter le nombre des demandes par opérateur à une seule demande de certificat par contingent.
(7) In order to ensure that applications for import licences are genuine, to prevent speculation and ensure maximum utilisation of the quotas opened, individual applications should be restricted to 10 % of the quota concerned, applicants should no longer be permitted to refuse licences where the allocation factor is less than 0,8, quotas should be open only to importers who have imported or exported the products covered by those quotas, criteria should be laid down to restrict eligibility to apply for licences by requiring all applicants to provide documents proving their status and regular activity as traders and each importer should be allowed to lodge only one licence application per quota.
