The Charter of Fundamental Rights of the European Union (the Charter) reaffirms, with due regard for the EU’s powers and tasks and for the principle of subsidiarity, the rights as they result, in particular, from the constitutional traditions and international obligations common to EU countries, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Social Charters adopted by the EU and by the Council of Europe and the case-law of the Court of Justice of the European Union and of the European Court of Human Rights.

In order to ensure respect for the rights guaranteed by the Charter of Fundamental Rights of the European Union (the ‘Charter’), in the case of auditors, external accountants and tax advisors, who, in some Member States, are entitled to defend or represent a client in the context of judicial proceedings or to ascertain a client's legal position, the information they obtain in the performance of those tasks should not be subject to the reporting obligations laid down in this Directive.

L’enregistrement des conversations téléphoniques ou des communications électroniques en rapport avec des ordres de clients est compatible avec la charte des droits fondamentaux de l’Union européenne (ci-après dénommée «charte») et est justifié en ce qu’il permet de renforcer la protection des investisseurs, d’améliorer la surveillance des marchés et d’accroître la sécurité juridique dans l’intérêt des entreprises d’investissement et de leurs clients.
Recording of telephone conversations or electronic communications involving client orders is compatible with the Charter of Fundamental Rights of the European Union (the Charter) and is justified in order to strengthen investor protection, to improve market surveillance and increase legal certainty in the interest of investment firms and their clients.
