Au vu de la jurisprudence rappelée aux points 43 à 45 du présent arrêt, le Tribunal considère que, eu égard aux obligations incombant à un jury de concours, la décision de ne pas inscrire un candidat sur une liste de réserve doit être annulée s’il s’avère que le concours était organisé d’une manière qui générait un risque d’inégalité de traitement supérieur à celui inhérent à tout concours, sans que le candidat concerné n’ait à fournir la preuve de ce que certains candidats ont été effectivement avantagés.
In the light of the case-law cited in paragraphs 43 to 45 above, the Tribunal considers that, in view of the obligations incumbent on a selection board, the decision not to include a candidate on a reserve list must be annulled if it transpires that the competition was organised in a way which led to a risk of inequality that was greater than that inherent in any competition, without the candidate concerned’s being required to provide evidence of the fact that some candidates were actually at an advantage.
