Partant, alors qu’il y avait trois catégories possibles de candidats, à savoir ceux qui étaient des fonctionnaires de l’Union, ceux qui avaient déjà été recrutés au SEAE en tant qu’agents temporaires au sens de l’article 2, sous e), du RAA et ceux qui, comme le requérant, ne rentraient ni dans l’une ni dans l’autre de ces catégories, l’avis de vacance a prévu que le classement en grade du candidat retenu se ferait, pour les fonctionnaires de l’Union, au grade qu’ils détenaient et, pour les autres, c’est-à-dire pour les membres du personnel des services diplomatiques nationaux des États membres, au grade AD 5.
Accordingly, whilst there were three possible categories of candidates, namely, those who were EU officials, those who had already been recruited to the EEAS as temporary staff within the meaning of Article 2(e) of the CEOS and those who, like the applicant, did not come within either of those categories, the vacancy notice provided that the successful candidate would, in the case of an EU official, be recruited at his existing grade and, in the case of the others, that is to say staff from the national diplomatic services of the Member States, at grade AD 5.

Accordingly, the vacancy notice does not differentiate as regards recruitment at the basic grade in function group AD depending on whether the successful candidate is an EU official or a member of staff of the national diplomatic service of a Member State.

In those circumstances, it was entirely legitimate for the vacancy notice to provide that the recruitment of a temporary agent would be at grade AD 5 whilst providing that an EU official in one of the grades AD 5 to AD 14 would be appointed in his existing grade, and the principle of equal treatment was not infringed so far as eligibility for EU officials and for staff from the national diplomatic services of the Member States to assume all positions under equivalent conditions and the grading of the successful candidate were concerned.

(b) where it is no longer compatible with the interpretation of one of the nomenclatures referred to in Article 20 (6) either at Community level by reason of amendments to the combined nomenclature or by a judgment of the Court of Justice of the European Communities, or, at international level by reason of a classification opinion or an amendment of the explanatory notes to the Nomenclature of the Harmonized Commodity Description and Coding System adopted by the Customs Cooperation Council; in that case the date on which binding tariff information ceases to be valid shall be the date of publication of the said measures or, in the case of international measures, the date of the Commission communication, in the 'C' of the Official Journal of the European Communities;
