IN-CONTEXT TRANSLATIONS

1. Le présent règlement établit des règles pour le renouvellement d'une autorisation nationale pour un produit biocide ou une famille de produits biocides ayant fait l'objet d'une reconnaissance mutuelle conformément à l'article 4 de la directive 98/8/CE ou aux articles 33 et 34 du règlement (UE) no 528/2012, ou d'une autorisation nationale octroyée par voie de reconnaissance mutuelle (ci-après dénommée «autorisation»).
1. This Regulation lays down rules for the renewal of a national authorisation of a biocidal product or a biocidal product family that has been subject to mutual recognition in accordance with Article 4 of Directive 98/8/EC or with Articles 33 and 34 of Regulation (EU) No 528/2012, or of a national authorisation granted through such mutual recognition (hereinafter referred to as an ‘authorisation’).

It is appropriate to lay down supplementary rules for the renewal of national authorisations having been subject to mutual recognition in accordance with Article 4 of Directive 98/8/EC of the European Parliament and of the Council (2) or with Articles 33 and 34 of Regulation (EU) No 528/2012, both in the Member States where the first authorisations were granted and in those Member States having granted authorisations through mutual recognition of the first authorisations.

The competent authorities shall in particular update the information in the Register for Biocidal Products relating to biocidal products which have been authorised within their territory; for which a national authorisation has been refused, amended, renewed or cancelled, or for which a parallel trade permit has been granted, refused or cancelled.

8. Si, pour des raisons indépendantes de la volonté du titulaire de l'autorisation nationale, aucune décision n'est prise sur le renouvellement de l'autorisation nationale avant l'expiration de celle-ci, l'autorité compétente réceptrice renouvelle l'autorisation nationale pour la durée nécessaire à l'achèvement de l'évaluation.
8. Where, for reasons beyond the control of the holder of the national authorisation, no decision is taken on the renewal of the national authorisation before its expiry, the receiving competent authority shall grant the renewal of the national authorisation for the period necessary to complete the evaluation.

1. Where no application for a national authorisation has been submitted in a Member State for a biocidal product that is already authorised in another Member State, official or scientific bodies involved in pest control activities or professional organisations may apply, with the consent of the authorisation holder in another Member State, for a national authorisation for the same biocidal product, the same use and under the same conditions for use in that Member State under the mutual recognition procedure provided for in Article 25.

If the Commission decision confirms the initial national authorisation, the competent authority that proposed to refuse to recognise a national authorisation, or to recognise the national authorisation subject to certain conditions, shall without delay authorise the biocidal product concerned in accordance with the initial authorisation.

Should it be decided pursuant to the preceding subparagraph that the national authorization should be revoked, this decision shall apply to any other national authorization in respect of the substance in question.

Notwithstanding Article 4 and without prejudice to Article 8 (2), a Member State may authorize the use within its territory of other substances not contained in the lists of substances allowed, for certain cosmetic products specified in its national authorization, subject to the following conditions: (a) the authorization must be limited to a maximum period of three years;

SHOULD IT BE DECIDED PURSUANT TO THE PRECEDING SUBPARAGRAPH THAT THE NATIONAL AUTHORIZATION SHOULD BE REVOKED , THIS DECISION SHALL APPLY TO ANY OTHER NATIONAL AUTHORIZATION IN RESPECT OF THE SUBSTANCE IN QUESTION .
