Les dispositions de la sixième directive 77/388/CEE du Conseil, du 17 mai 1977, en matière d’harmonisation des législations des États membres relatives aux taxes sur le chiffre d’affaires — Système commun de taxe sur la valeur ajoutée: assiette uniforme, doivent être interprétées en ce sens que les principes définis par la Cour de justice de l’Union européenne dans l’arrêt du 24 octobre 1996, Elida Gibbs (C-317/94), concernant la détermination de la base d’imposition de la taxe sur la valeur ajoutée ne s’appliquent pas lorsqu’une agence de voyages, agissant en qualité d’intermédiaire, accorde au consommateur final, de sa propre initiative et à ses propres frais, une réduction de prix sur la prestation principale fournie par l’organisateur de circuits touristiques.
The provisions of Sixth Council Directive 77/388/EEC of 17 May 1977 on the harmonisation of the laws of the Member States relating to turnover taxes — Common system of value added tax: uniform basis of assessment, must be interpreted as meaning that the principles established by the Court of Justice of the European Union in Case C-317/94 Elida Gibbs [1996] ECR I-5339 concerning the determination of the taxable amount for VAT purposes do not apply when a travel agent, acting as an intermediary, grants to the final consumer, on the travel agent’s own initiative and at his own expense, a price reduction on the principal service provided by the tour operator.

With a view to the special nature of litigation before the Community Patent Court, i.e. private party patent litigation, some provisions of the Statute of the Court of Justice cannot apply e.g. those concerning the review of the legality of Community acts, others need amendments e.g. those concerning the procedure, the production of evidence or the revision of a judgment and finally some provisions need to be added e.g. those concerning the enforcement of decisions of the Community Patent Court or court fees.

(15) Whereas the buyers or users of feed materials should throughout the feed chain be given accurate and valid additional information, such as the quantities of analytical constituents having a direct effect on the quality of the feed material; whereas failure by the seller to declare the quantities of analytical constituents should be avoided in order to protect small buyers claiming this information in vain and to avoid the unnecessary costs of a multiplication of analyses immediately before the end of the feed chain; whereas certain Member States experience difficulties in conducting inspections at farm level; whereas under these circumstances it is necessary to adopt provisions requiring the quantities of analytical constituents to be declared at the beginning of the feed chain;
