TRADUCTIONS EN CONTEXTE

L’arrêt du Tribunal est erroné en ce que: i) il contredit des décisions antérieures rendues sur la même question (T-332/06 et C-194/09 P); ii) en faisant application de l’article 107, paragraphe 1, TFUE, il confond deux critères, qui sont tous deux nécessaires pour qu’il y ait une aide, en faisant découler l’existence d’un avantage pour Alcoa de la simple constatation du caractère étatique des ressources qui ont été employées; iii) il est dépourvu d’une motivation appropriée dès lors qu’il n’a pas relevé que la Commission avait présumé à tort que la mesure procurait un avantage à Alcoa et n’avait donc pas effectué d’analyse économique appropriée pour apprécier, le cas échéant, la valeur de cet avantage.
The General Court erred in its judgment in so far as (i) it was inconsistent with previous judgments handed down on the same question (T-332/06 and C-194/09 P); (ii) when applying Article 107(1) TFEU, it confused two criteria, both necessary to prove the existence of aid, inferring that an advantage was conferred on Alcoa from the mere finding that the resources used were of State origin; (iii) it failed to provide an adequate statement of reasons in so far as it failed to observe that the Commission had erred in assuming that Alcoa had obtained an advantage from the measure and had not, therefore, to that end, carried out a proper economic analysis to calculate the extent of the advantage in this particular case.

Aux points 81 à 83 de l’arrêt attaqué, le Tribunal a procédé à une lecture erronée des dispositions applicables au cas d’espèce et en particulier de l’article 15 de la décision no 204/99 de l’Autorità per l’energia elettrica e il gas, qui montre de manière claire et univoque que — même après l’introduction de la composante compensatoire — le tarif Alumix n’a été modifié en substance ni quant au prix net de l’électricité payé par Alcoa ni quant au financement du mécanisme qui assurait ce prix à Alcoa.
The General Court, in paragraphs 81 to 83 of the judgment under appeal, misread the provisions applicable to the present case, in particular, Article 15.2 of Resolution No 204/99 of the Autorità per l’energia elettrica e il gas (Italian Electricity and Gas Authority), which shows clearly and unequivocally that — even after the introduction of the compensation component — the Alumix tariff did not undergo any substantive change either in respect of the net electricity price paid by Alcoa or in respect of the financing of the mechanism which guaranteed that supply price for Alcoa.

The General Court infringed Article 107(1) TFEU, was inconsistent with the judgments handed down in Cases T-332/06 and C-149/09 P and seriously distorted point (b) of Alcoa’s first plea, regarding the Commission’s finding that it was not necessary to conduct any economic analysis to demonstrate that the measure granted an economic advantage to Alcoa.

Erreur de procédure due à la déformation et à la dénaturation par le Tribunal du deuxième moyen d’Alcoa et, en conséquence, omission de statuer et motivation incorrecte.
The General Court committed a procedural error in that it misrepresented and distorted Alcoa’s second plea and consequently failed to adjudicate and to provide an adequate statement of reasons.

F. whereas this problem is particularly acute in the less economically developed Member States, in the light of the relocations, recently carried out or announced, of a number of companies or branches of companies (such as CJ Clark, Gerry Weber, Bagir, Sasimac, Schuh-Union, Scottwool, Ecco'let, Bawo, Rohde, Philips, Yasaki Saltano, Efacec, Eres, Alcoa, Delphy, Alcatel and Eftec), which will make thousands of workers redundant and jeopardise progress towards economic and social cohesion,
