Dans la communication consacrée à la question de « mieux légiférer » [2], la Commission a précisé que le recours aux agences de régulation s'insère dans la question plus générale de l'exercice de la fonction exécutive et de la définition des responsabilités des institutions.
In its Communication on "better lawmaking" [2], the Commission placed the use of regulatory agencies in the broader context of exercise of the executive function and definition of the responsibilities of the institutions.

For the purposes of this framework, the regulatory agencies can be divided into decision-making agencies empowered, inter alia, to enact instruments binding on third parties, and executive agencies responsible for performing various executive tasks to assist the Commission in the discharge of its responsibilities but without any real decision-making powers.

More pragmatic discussions conducted by the Commission have identified the profiles of two type of agencies: executive and regulatory ones.

Supports the Commission's decision not to propose any new regulatory agencies until its evaluation is complete at the end of 2009; supports, however, the decision to proceed with the proposal to establish new regulatory agencies in the fields of energy and telecoms; points out that those two new agencies and the existing agencies will have to comply with the future general framework that establishes the role, structure, mandate, accountability, legitimacy and transparency of regulatory agencies; calls for an evaluation of existing agencies once an agreement on a common framework has been reached; encourages amending the basic acts governing existing regulatory agencies in order to make them consistent with such an agreed common framework;

L. rappelant que la Commission, dans sa communication comme précédemment dans le Livre blanc "Gouvernance", se concentre sur les futures agences "de régulation" , à savoir des agences qui sont "chargées de participer de manière active à l'exercice de la fonction exécutive, en posant des actes qui contribuent à la régulation d'un secteur déterminé" (p. 4 de la communication), ne se prononce pas sur le sort des agences existantes et laisse de côté les agences établies hors du cadre du traité CE; considérant qu'une telle approche ne semble pas inappropriée dans le cadre d'une réflexion consacrée aux nouvelles formes de "Gouvernance" qui peuvent être réalisées "à droit constant", mais qu'elle ne doit pas faire oublier que les anciennes agences et celles créées sur la base du traité sur l'Union méritent aussi d'urgence une réflexion et des propositions de modification, afin de les aligner sur les orientations communes à définir entre les institutions,
L. pointing out that the Commission, both in its Communication and previously in the White Paper on Governance, focuses on future "regulatory" agencies, i.e. agencies "required to be actively involved in exercising the executive function by enacting instruments which contribute to regulating a specific sector" (page 4 of its Communication), but does not mention the fate of existing agencies and leaves aside agencies established outside the framework of the EC Treaty; whereas such an approach does not appear inappropriate in the context of reflection on new forms of "governance" which may be introduced "without departing from the law as it stands", it must not disregard, however, the fact that older agencies and those created on the basis of the EU Treaty also merit consideration and, as a matter of urgency, require proposals for modification in order to bring them into line with a common approach to be agreed between the institutions,
