Mr. Vito Signorile: To summarize our position, before any MAI-type expansion of international commerce, we need a binding declaration of the priority of human rights over any other category of rights, a clear policy on reasonable limits to size, including support for regional and local commercial activity, and finally, a binding recognition that no agreements can be made that will effectively deprive citizens of their rights and duties respecting the communities in which they live.

In particular, the Commission charged the different Member States (a) with having infringed the principles relating to the division of external powers between the Community and the Member States (a charge not made, however, against the United Kingdom), (b) with having infringed the provisions of the EC Treaty on the right of establishment by inserting in the agreements a "nationality clause", which in practice allows each party to refuse the rights provided for in the agreements themselves to air carriers designated by the other contracting State but not owned or controlled by nationals of that State and (c), in the event of the provisions that are contrary to Community law being held to predate the entry into force of the Treaty, with having failed to do everything possible to render those provisions fully compatible with the Community legislation (a charge not made against the United Kingdom).

1. Les droits de douane à l'importation ou à l'exportation sont supprimés dans les échanges entre les parties des produits mentionnés à l'article 1er à compter de la date d'entrée en vigueur du présent accord, sauf les droits de douane à l'importation en Turquie des produits énumérés à l'annexe II, qui sont supprimés en trois ans, à partir du premier jour du mois suivant la date d'entrée en vigueur de l'accord conformément à l'article 20, selon le calendrier établi à l'annexe II, à savoir une réduction de 50 % des droits consolidés spécifiés à l'annexe II pendant la première année suivant l'entrée en vigueur du présent accord et une réduction supplémentaire de 25 % de ces droits pendant la deuxième et la troisième années suivant l'entrée en vigueur du présent accord.
1. Customs duties on imports or exports shall be abolished in trade between the Parties in the products referred to in Article 1 on the date of entry into force of this Agreement, save that customs duties in respect of imports into Turkey of those products set out in Annex II shall be abolished over three years beginning on the first day of the month following the date on which the Agreement enters into force pursuant to Article 20 in accordance with the schedule set out in Annex II, namely a reduction to 50 % of the consolidated duties specified in Annex II during the first year of this Agreement and by way of a further reduction to 25 % of those duties during the second and third years of this Agreement.
