L. whereas the EU has imposed an arms embargo and further targeted sanctions against a Houthi leader who is the son of former president Saleh; whereas, at the same time, EU Member States such as the United Kingdom, Spain, France, Italy and Germany continue to sell weapons to Saudi Arabia; whereas both the UK and Spain have significantly increased their supply of weapons; whereas Saudi Arabia is the UK’s largest customer for weapons, and the UK is the biggest supplier of weapons to Gulf Cooperation Council countries; whereas the Control Arms coalition has denounced that this trade is in breach of the UK’s obligations under the Arms Trade Treaty, the EU Common Position on Arms Exports and the UK’s Consolidated Criteria on Arms Exports;

(2) Notwithstanding the legal obligations of the United Kingdom deriving from to both Council Decision 2005/681/JHA and the Headquarters Agreement concluded between the Government of the United Kingdom and CEPOL on 30 December 2004, by letters of 12 December 2012 and 8 February 2013, the United Kingdom informed CEPOL that it had unilaterally decided that it no longer wished to host the seat on its territory.

‘2. By judgment of 7 May 2008, the Court of Appeal of England and Wales (United Kingdom) (“the Court of Appeal”) dismissed the application of [the Home Secretary] for permission to appeal to that court against [the POAC]’s decision of 30 November 2007 by which it had allowed an appeal against the Home Secretary’s decision of 1 September 2006 refusing to lift the proscription of [the PMOI] as an organisation concerned in terrorism and ordered the Home Secretary to lay before the United Kingdom Parliament the draft of an Order removing the applicant from the list of organisations proscribed in the United Kingdom under the Terrorism Act 2000.

This Decision is without prejudice to the position of the United Kingdom and Ireland under the Protocol integrating the Schengen acquis into the framework of the European Union and under the Protocol on the position of the United Kingdom and Ireland, annexed to the Treaty on European Union and the Treaty establishing the European Community, hence the UK and Ireland are not bound by this Decision to the extent that it concerns the exercise of an external power by the Community in fields where its internal legislation does not bind the UK and/or Ireland.

The necessary arrangements concerning the accommodation to be provided for CEPOL in the United Kingdom and the facilities to be made available by the United Kingdom as well as particular rules applicable in the United Kingdom to members of CEPOL's organs, its Director, employees and members of their families shall be laid down in a headquarters agreement between CEPOL and the United Kingdom after obtaining the unanimous approval of the governing board.
