Export must be carried out under an export licence without refund issued in accordance with Article 23 of Regulation (EC) No 318/2006 and, for sugar, under quotas to be opened by the Commission taking into account the Community’s commitments under the World Trade Organisation.

Supports the Commission's legislative proposals, which are parallel and complementary to the European Economic Recovery Plan, to amend three of the existing Structural Funds Regulations 2007-2013 (Regulations (EC) No 1083/2006, No 1080/2006 and No 1081/2006); fully endorses the proposed changes that aim to improve cash flow and liquidity in the Member States, facilitate the use of financial engineering instruments, expand the possibilities for support to investments in energy efficiency and renewable energy in housing and increase the flexibility of the Structural Funds to adapt them to meet the needs of the extraordinary economic circumstances with a long-term perspective;

Néanmoins, le rapporteur note les spécificités de la BEI au regard, notamment, du fonctionnement de ses capitaux propres : faiblesse des capitaux libéré par rapport au capital souscrit ; soit 8,2 Mrd€ libérés pour un capital souscrit de 163,7 Mrd€ au 31 décembre 2006, capacité du conseil d’administration d’exiger, pour faire face aux besoins de la banque, le versement de tout ou partie du solde du capital souscrit non libéré (soit en théorie 155 Mrd€), ratio prudentiel particulier fixé à l’article 18 point 5 des statuts de la Banque qui prévoit une limitation des engagements à 2,5 fois les capitaux propres souscrit (ratio très peu modifié par le traité de Lisbonne en cours de ratification), etc.
The rapporteur nevertheless notes the specific situation of the Bank in respect, for example, of the operation of its own capital: low paid-up capital in comparison with capital subscribed (EUR 8.2 billion paid up as against a subscribed capital of EUR 163.7 billion on 31 December 2006); the ability of the EIB’s Board of Directors to require payment, in order to cover the Bank’s needs, of all or part of the balance of the unpaid subscribed capital (i.e. in theory, EUR 155 billion); the specific prudential ratio laid down in Article 18(5) of the Bank’s Statute, which provides for a restriction of commitments to no more than 2.5 times the subscribed capital (a ratio which is very slightly altered by the Lisbon Treaty, currently undergoing ratification), etc.
