Accordingly, the Commission’s assessment in the present case is based on the undertaking given by Greece that its envisaged contribution to TAP-OTE will not exceed the amount of EUR 390,4 million that corresponds to the extra costs of the VRS for OTE, and that, if necessary, it will also repeal Law No 3371/2005.

Il est important de souligner que la présente décision a été prise sur la base de l’engagement formel des autorités grecques selon lequel la loi no 3371/2005 serait abrogée si, à la date du transfert au TAP-OTE des 4 % de leur participation dans l’OTE, la valeur des actions transférées dépassait le coût supplémentaire du RPV de l’OTE, tel qu’il a été vérifié et accepté par la Commission.
It should be stressed that this Decision has been drawn up on the basis of the explicit undertaking given by the Greek authorities that they will repeal Law No 3371/2005 if on the date of the transfer to TAP-OTE of their 4 % shareholding in OTE the value of the shares thus transferred exceeds the extra costs of the VRS of OTE as verified and accepted by the Commission.
