If a supply is deemed under subparagraph 184.1(2)(a)(i) of the Act to have been made in British Columbia by a surety as a result of the surety carrying on a particular construction of real property situated in that province as full or partial satisfaction of the surety’s obligation under a bond, if a contract payment (within the meaning of paragraph 184.1(2)(a) of the Act) in respect of the particular construction becomes due or is paid without having become due before April 1, 2013 and if another contract payment in respect of the particular construction becomes due on or after that day without having been paid before that day or is paid without having become due on or after that day, then, in applying subsection 184.1(2) of the Act in respect of the particular construction, the formula and descriptions in clause 184.1(2)(d)(i)(A) of the Act are adapted to be read as follows:

Clause 9 of the bill limits, to a certain extent, the scope of section 184.4 by replacing “unlawful act” with “offence,” which is defined in section 183 of the Code.35 Therefore, the interception of communications without authorization in the exceptional circumstances set out in section 184.4 is not permitted except in regard to the offences set out in section 183, as is the case for most other types of interception under Part VI.

However, other types of interception and electronic surveillance set out in the Code are still not subject to the requirement for governments to present a public report on their use: interception to prevent bodily harm without judicial authorization (section 184.1), interception with the consent of one of the parties to the communication (section 184.2) and use of a tracking device (section 492.1) or “number recorder” (section 492.2).

For example, clause 5 could be amended to ensure that Parliament is provided with clear information not just about the number of arrests or the number of prosecutions or the number of crimes that had been discovered by virtue of section 184.4; the reporting could include the number of times there were no arrests, the number of times there were no offences, and the reasons for section 184.4 urgency.
