Reminds the Commission to monitor all new legislative proposals for compliance with the Charter, and to check existing instruments in this respect; suggests that the impact assessments accompanying Commission proposals should clearly indicate whether such proposals comply with the Charter, so that this consideration becomes an integral part of the bringing forward of legislative proposals; recalls the Commission of its explicit task to involve parties concerned by broad consultations in order to ensure coherence and transparency in the Union's actions (Article 11(3) TEU); underlines in this regard the importance of the FRA Platform as a significant resource for fulfilling this task;

Other potentially affected fundamental rights enshrined in the Charter are the following: freedom of expression (Article 11 of the Charter); freedom to conduct a business (Article 16); the right to property and in particular the protection of intellectual property (Article 17(2)); the prohibition of any discrimination amongst others on grounds such as race, ethnic origin, genetic features, religion or belief, political opinion or any other opinion, disability or sexual orientation (Article 21); the rights of the child (Article 24); the right to a high level of human health care (Article 35); the right of access to documents (Article 42); the right to an effective remedy and a fair trial (Article 47).

C. whereas, in its above-mentioned resolution of 11 July 2007, in giving its opinion on the convening of the 2007 IGC, it welcomed the fact that the IGC mandate safeguarded the legally binding status of the Charter of Fundamental Rights, while expressing its strong concerns about the Protocol on the application of the Charter of Fundamental Rights of the European Union to Poland and to the United Kingdom, which seeks to limit the justiciability of the Charter in certain Member States,

F. whereas the protection of human rights has become a priority objective of the European Union by Articles 6 and 7 of the EU Treaty, with the adoption of the Charter of Fundamental Rights, the approval of the Copenhagen criteria for the accession countries, the strengthening of the provisions on European citizenship, the development of an area of freedom, security and justice, the promotion of transparency and privacy, and the prevention of discrimination, and Article II-11(2) of the draft Constitution drawn up by the European Convention provides for the incorporation of the Charter of Fundamental Rights in the Constitution of the European Union;
