Member States shall ensure that, from 1 January 2005, no installation or aircraft undertakes any activity listed in Annex I resulting in emissions specified in relation to that activity unless its operator or aircraft operator holds a permit issued by a competent authority in accordance with Articles 5 and 6, or the installation or aircraft is temporarily excluded from the Community scheme pursuant to Article 27".

"air operator's certificate (AOC) ' means a certificate issued to an undertaking affirming that the operator in question has the professional ability and organisation to secure the safe operation of aircraft for the aviation activities specified in the certificate, as provided in the relevant provisions of Community law;

Without prejudice to the powers of Member States in the exercise of their public authority, the European Community, acting within the limits of the powers conferred on it by the Treaty establishing the European Community, shall prevent the direct or indirect supply, sale and transfer to the individuals, groups, undertakings and entities referred to in Article 1 of technical advice, assistance, or training related to military activities from the territories of the Member States, or using their flag vessels or aircraft, or by nationals of Member States outside their territories, under the conditions set out in UNSCR 1390(2002).
2. Onverminderd de bevoegdheden van de lidstaten bij de uitoefening van het openbaar gezag voorkomt de Gemeenschap, handelend binnen de grenzen van de haar bij het Verdrag tot oprichting van de Europese Gemeenschap verleende bevoegdheden, de directe of indirecte levering, verkoop en toezending van technisch advies, bijstand of opleiding in verband met militaire activiteiten aan de in artikel 1 bedoelde personen, groepen, ondernemingen of entiteiten, vanaf het grondgebied van de lidstaten alsmede met onder hun vlag opererende schepen of vliegtuigen en door onderdanen van de lidstaten buiten hun grondgebied, overeenkomstig de bepalingen van UNSCR 1390(2002).

The expression "Air operator's certificate" means a document issued to an undertaking or a group of undertakings by the competent authorities which affirms that the operator in question has the professional ability and organisation to secure the safe operation of aircraft for the aviation activities specified in the certificate.
