Richtlijn 95/46/EG van het Europees Parlement en de Raad van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens verplicht de lidstaten ervoor te zorgen dat de controlerende instantie passende technische en organisatorische maatregelen treft om persoonsgegevens te beveiligen tegen vernietiging, hetzij accidenteel, hetzij onrechtmatig, tegen accidenteel verlies, vervalsing, ongeautoriseerde verspreiding of toegang, met name als de verwerking betrekking heeft op de verzending van gegevens over een netwerk, en tegen enige andere vorm van onwettige verwerking.

In the event of a privacy incident (including unauthorised access or disclosure), DHS shall take reasonable measures to notify affected individuals as appropriate, to mitigate the risk of harm of unauthorised disclosures of personal data and information, and to institute remedial measures as may be technically practicable.

Indien er zich een incident in verband met gegevensbescherming (waaronder niet-geautoriseerde toegang of bekendmaking) voordoet, neemt het DHS redelijke maatregelen om de getroffen personen op passende wijze in te lichten en het risico van schade door een niet-geautoriseerde bekendmaking van persoonsgegevens en persoonlijke informatie te beperken, alsook technisch haalbare herstelmaatregelen.

In the light of Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data , it is necessary to provide, in relation to the information and publicity measures and audit work under this Decision, that the Commission and the Member States should prevent any unauthorised disclosure of or access to personal data and to specify the purpose for which the Commission and the Member States may process such data.

Eurojust and, insofar as it is concerned by data transmitted from Eurojust, each Member State, shall, as regards the processing of personal data within the framework of this Decision, protect personal data against accidental or unlawful destruction, accidental loss or unauthorised disclosure, alteration and access or any other unauthorised form of processing.
