TRADUCTIONS EN CONTEXTE

For the purposes of exempting tobacco imported into the Canary Islands from customs duties, it is necessary to define the annual period for calculating the maximum quantity of tobacco products referred to in Article 22 of Regulation (EC) No 247/2006 and to define the term ‘local manufacture of tobacco products’.
Met het oog op de vrijstelling van douanerechten bij de invoer van tabak op de Canarische eilanden moet de jaarperiode voor de berekening van de in artikel 22 van Verordening (EG) nr. 247/2006 bedoelde jaarlijkse maximumhoeveelheid worden bepaald en moet het begrip „lokale vervaardiging van tabaksfabricaten” worden omschreven.

3. The quantities of unmanufactured and semi-manufactured tobacco referred to in Article 22(1) of Regulation (EC) No 247/2006 shall be converted into quantities of unmanufactured stemmed/stripped tobacco on the basis of the coefficients of equivalence given in Annex VIII to this Regulation.

2. For the purposes of applying Article 22 of Regulation (EC) No 247/2006, ‘local manufacture of tobacco products’ means any operation carried out in the Canary Islands aimed at processing the products listed in Annex VIII to this Regulation into manufactured products ready to smoke.

In order to ensure that this Directive is fully operational and to adapt it to technical, scientific and international developments in tobacco manufacture, consumption and regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of adopting and adapting maximum emission levels and methods for measuring those emissions, setting maximum levels for additives that result in a characterising flavour or that increase toxicity or addictiveness, withdrawing certain exemptions granted to tobacco products other than cigarettes and roll-your-own tobacco, adapting the health warnings, establishing and adapting the picture library, defining the key elements of the data storage contracts to be concluded for the purposes of the tracking and tracing system, and extending measures adopted by Member States to the entire Union concerning specific electronic cigarettes or refill containers or a type of electronic cigarette or refill container.

Must the description of customs goods as ‘Light air-cured tobacco’ in accordance with heading CN 2401 10 35 of Chapter 24 ‘TOBACCO AND MANUFACTURED TOBACCO SUBSTITUTES’ in Commission Regulation (EU) No 861/2010 (1) of 5 October 2010 amending Annex I to Council Regulation (EEC) No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff be interpreted as meaning that it includes only air cured tobacco, not stemmed/stripped:

This action underpins EU efforts in the area of tobacco control and supports the implementation of Directive 2001/37/EC of the European Parliament and of the Council of 5 June 2001 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products (47), Directive 2003/33/EC of the European Parliament and of the Council of 26 May 2003 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products (48), Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (49) and Council Recommendation 2003/54/EC of 2 December 2002 on the prevention of smoking and on initiatives to improve tobacco control (50).
