Article 19 of Regulation (EC) No 1393/2007 of the European Parliament and of the Council of 13 November 2007 on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters (service of documents) shall apply instead of paragraph 2 of this Article if the document instituting the proceedings or an equivalent document had to be transmitted from one Member State to another pursuant to that Regulation.
3. Artikel 19 van Verordening (EG) nr. 1393/2007 van het Europees Parlement en de Raad van 13 november 2007 inzake de betekening en de kennisgeving in de lidstaten van gerechtelijke en buitengerechtelijke stukken in burgerlijke of in handelszaken („de betekening en de kennisgeving van stukken”) is van toepassing in plaats van lid 2 van dit artikel, indien de toezending van een lidstaat naar een andere lidstaat van het stuk dat het geding inleidt of een gelijkwaardig stuk, overeenkomstig die verordening moest plaatsvinden.

2. Without prejudice to Article 18 of the service provision Regulation, the relevant documentation shall be put at the disposal of airspace users’ representatives, the Commission, Eurocontrol and national supervisory authorities three weeks before the consultation hearing.

In October 2007, Roda Golf Beach Resort SL, a company incorporated under Spanish law, had executed before a notary in San Javier, a document for the purpose of transmitting, in accordance with the Regulation on service of documents, sixteen letters to addressees with an address for service in the United Kingdom and Ireland through the registry of the Juzgado de Primera Instancia de Instrucción de San Javier (Spain).

(21) When a document has to be sent from one Member State to another for service there, this Regulation and in particular the rules on service set out herein should apply together with Council Regulation (EC) No 1348/2000 of 29 May 2000 on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters(7), and in particular Article 14 thereof in conjunction with Member States declarations made under Article 23 thereof.
