Vooraf dient te worden opgemerkt dat in procedures over de verlichting van lasten voor pensioenen van ambtenaren bij voormalige exploitanten met een monopoliepositie in de telecomsector (met name OTE in Griekenland en BT plc in het Verenigd Koninkrijk) de Commissie met name is nagegaan of deze ondernemingen vergelijkbare sociale lasten moesten betalen als die van hun concurrenten, om te besluiten of de steunmaatregelen voor de betreffende exploitanten al dan niet verenigbaar waren met de interne markt overeenkomstig artikel 107, lid 3, onder c), VWEU (63).
