Radio direction finding equipment operating at frequencies above 30 MHz and having all of the following, and specially designed components therefor:

1. Where, having carried out an evaluation under Article 40(1), a Member State finds that although radio equipment is in compliance with this Directive, it presents a risk to the health or safety of persons or to other aspects of public interest protection covered by this Directive, it shall require the relevant economic operator to take all appropriate measures to ensure that the radio equipment concerned, when placed on the market, no longer presents that risk, to withdraw the radio equipment from the market or to recall it within a reasonable period, commensurate with the nature of the risk, as it may prescribe.
1. Wanneer een lidstaat na een beoordeling overeenkomstig artikel 40, lid 1, te hebben verricht, vaststelt dat radioapparatuur die conform is met deze richtlijn toch een risico voor de gezondheid of veiligheid van personen of voor andere onder deze richtlijn vallende aspecten van de bescherming van algemene belangen meebrengt, verlangt deze lidstaat van de desbetreffende marktdeelnemer dat hij alle passende maatregelen neemt om ervoor te zorgen dat de radioapparatuur dat risico niet meer meebrengt wanneer zij in de handel wordt gebracht, of om de radioapparatuur binnen een door de lidstaat vast te stellen redelijke termijn, die evenredig is met de aard van het risico, uit de handel te nemen of terug te roepen.

Where, in the course of the evaluation referred to in the first subparagraph, the market surveillance authorities find that the radio equipment does not comply with the requirements laid down in this Directive, they shall without delay require the relevant economic operator to take all appropriate corrective actions to bring the radio equipment into compliance with those requirements, to withdraw the radio equipment from the market, or to recall it within a reasonable period, commensurate with the nature of the risk, as they may prescribe.
Wanneer de markttoezichtautoriteiten bij de in de eerste alinea bedoelde beoordeling vaststellen dat de radioapparatuur niet aan de eisen van deze richtlijn voldoet, verlangen zij onverwijld van de betrokken marktdeelnemer dat hij passende corrigerende maatregelen neemt om de radioapparatuur met deze eisen conform te maken of binnen een door hen vast te stellen redelijke termijn, die evenredig is met de aard van het risico, uit de handel te nemen of terug te roepen.

Portable or mobile radiotelephones for civil use (e.g., for use with commercial civil cellular radio communication systems) that are not capable of transmitting encrypted data directly to another radiotelephone or equipment (other than Radio Access Network (RAN) equipment), nor of passing encrypted data through RAN equipment (e.g., Radio Network Controller (RNC) or Base Station Controller (BSC));

17. The provision of satellite network services for the conveyance of radio and television programmes is a telecommunications service for the purpose of this Directive and thus subject to its provisions. Notwithstanding the abolition of certain special and exclusive rights in respect of receive-only satellite earth stations not connected to the public network of a Member State and the abolition of special and exclusive rights in respect of satellite services provided for public or private broadcasters, the content of satellite broadcasting services to the general public or private broadcasters, the content of satellite broadcasting services to the general public provided via frequency bands defined in the Radio Regulations for both Broadcasting Satellite Services (BSS) and Fixed-Satellite Services (FSS) will continue to be subject to specific rules adopted by Member States in accordance with Community law and is not, therefore, subject to the provisions of this Directive.
17. Overwegende dat het aanbieden van satellietnetwerkdiensten voor het doorgeven van radio- en televisieprogramma's een telecommunicatiedienst is in de zin van deze richtlijn; dat derhalve de bepalingen van deze richtlijn daarop van toepassing zijn; dat niettegenstaande de afschaffing van bepaalde bijzondere en uitsluitende rechten met betrekking tot ontvanggrondstations die niet op het openbare net van een Lid-Staat zijn aangesloten, en de opschaffing van bijzondere en uitsluitende rechten met betrekking tot satellietdiensten ten behoeve van openbare of particuliere omroepinstellingen, op de inhoud van satellietomroepdiensten voor het algemene publiek, die via de frequentiebanden die in het Radioreglement voor satellietomroepdiensten en vastesatellietdiensten bedoeld zijn, worden aangeboden, specifieke voorschriften van toepassing blijven, die door de Lid-Staten in overeenstemming met het Gemeenschapsrecht worden vastgesteld; dat derhalve de bepalingen van deze richtlijn niet daarop van toepassing zijn;
