The move is motivated by three concerns: to systematise and rationalise the wide range of consultation practices and procedures, and to guarantee the feasibility and effectiveness of the operation; to ensure the transparency of consultation from the point of view of the bodies or persons consulted and from the legislator's point of view; and to demonstrate accountability vis-à-vis the bodies or players consulted, by making public, as far as possible, the results of the consultation and the lessons that have been learned.

Each public consultation shall cover all subject matters relevant to the particular stage of the procedure, and one subject matter relevant to the particular stage of the procedure shall not be addressed in more than one public consultation; however, one public consultation may take place in more than one geographical location.

In the period between 2008 and 2012 the Commission services organised a number of consultations and discussions with experts and key stakeholders concerning bank recovery and resolutionAs the last public consultation before the adoption of the proposal, a Commission Staff Working Paper describing in detail the potential policy options under consideration by the Commission services was published for consultation in January 2011. The consultation ended on the 3rd of March 2011. On one of the resolution tools, the so called bail-in or debt write down tool, targeted discussions were organised with experts from Member States, banking industry, academic world and legal firms in April 2012. The discussions concerned the key parameters of the debt write-down tool, including in particular the resolution triggers, the scope of bail-in, its potential minimum level, resolution of groups as well as grandfathering. 2. Urges the Commission to ensure that every EU citizen's right to address the EU institutions in any of the EU official languages is fully respected and implemented by ensuring that public consultations are available in all EU official languages, that all consultations are treated equally and that there is no language-based discrimination between consultations;
2. dringt er bij de Commissie op aan om ervoor te zorgen dat het recht van iedere burger om zich tot de EU-instellingen te richten in elke officiële EU-taal volledig geëerbiedigd en ten uitvoer gelegd wordt door ervoor te zorgen dat openbare raadplegingen toegankelijk zijn in alle officiële EU-talen, dat alle raadplegingen evenwaardig zijn en dat er geen discriminatie op basis van taal plaatsvindt m.b.t. raadplegingen;

C. whereas the involvement of the public is a fundamental component of democratic governance, whereas well designed and communicated public consultations are one of the main tools giving substance to the EU's policy of transparency, and whereas to date their potential for bridging the communication and information gap between citizens and the EU has not been fully exploited;
C. overwegende dat publieke betrokkenheid een fundamenteel onderdeel uitmaakt van democratisch bestuur, overwegende dat goed vormgegeven en gecommuniceerde openbare raadplegingen behoren tot de belangrijkste instrumenten om het transparantiebeleid van de EU te concretiseren, en overwegende dat hun potentieel om de communicatie- en informatiekloof tussen burgers en de EU te overbruggen tot nu toe niet volledig benut is;

B. whereas citizens’ involvement in the decision-making process is a key element in democratic governance, and whereas well thought-out public consultations are important tools to use in ensuring that citizens and other parts of society are able to participate fully in that process, and in making headway with the European Union’s policy on transparency; whereas the potential of public consultations to bridge the communication and information gap between the citizens and the EU has not yet been fully exploited;
B. overwegende dat de participatie van de burgers aan het besluitvormingsproces een essentieel onderdeel vormt van het democratisch bestuur en dat goed georganiseerde openbare raadplegingen belangrijke instrumenten zijn om de burger en andere actoren in de samenleving ten volle deel te laten nemen aan dit proces en het EU-beleid voor transparantie te bevorderen; overwegende dat tot op heden het potentieel van openbare raadplegingen om de communicatie- en informatiekloof tussen de burgers en de Unie te dichten, nog niet volledig is benut;

8. Calls on the Commission to take into consideration, in its review of the public consultation mechanism, the wholly inadequate level of participation by civil society in these consultations; requests the Commission to adopt measures to ensure that substantially more European citizens take part in future public consultations than have done hitherto, such as by using accessible and easy-to-use online translation machines to make all public consultations and internet pages and related documents available in all EU official languages;
8. dringt er bij de Commissie op aan om met betrekking tot de openbare hoorzittingen te bedenken dat het maatschappelijk middenveld slechts in zeer beperkte mate deelneemt aan deze hoorzittingen; verzoekt de Commissie maatregelen te nemen om ervoor te zorgen dat aanzienlijk meer Europeanen dan tot dusver aan openbare hoorzittingen deelnemen, zoals door gebruik te maken van toegankelijke en gebruikersvriendelijke online vertaalmachines om alle openbare hoorzittingen, alsmede internetpagina's beschikbaar te stellen in alle officiële talen van de Europese Unie;

2. If, in the course of a consultation on the granting of a global arrangement — whether public or private in nature — a Member State or the Commission should request oral consultation and if in the course of this oral consultation seven Member States should request that all or some of the individual contracts to be charged to this global arrangement constitute the subject of prior consultations, consultation shall be applicable to such contracts.

A further advantage is that transparent and coherent consultation processes run by the Commission not only allow the general public to be more involved, they also give the legislature greater scope for scrutinising the Commission's activities (e.g. by making available documents summarising the outcome of the consultation process).
