Mr Jürgen SCHOLZ is hereby appointed Head of Mission of the European Union Police Mission in the former Yugoslav Republic of Macedonia (EUPOL Proxima) from 15 December 2004.

Having regard to Council Joint Action 2004/789/CFSP of 22 November 2004 on the extension of the European Union Police Mission in the former Yugoslav Republic of Macedonia (EUPOL Proxima), and in particular Article 8(1) thereof,

11. Notes the valuable experience gained in civilian and police missions over the course of the last two years, including: the assumption of control by the International Police Task Force (now EUPM) in Bosnia-Herzegovina since 2003; PROXIMA in The Former Yugoslav Republic of Macedonia (FYROM) and EUJUST THEMIS in Georgia; welcomes also the forthcoming deployment of a European Union police force in the Democratic Republic of the Congo (EUPOL Kinshasa);
11. merkt de waardevolle ervaring op die de afgelopen twee jaar is opgedaan met civiele en politionele missies zoals: de machtsovername door de Internationale Politiemacht (nu EUPM) in Bosnië-Herzegovina vanaf 2003; PROXIMA in de Voormalige Joegoslavische Republiek Macedonië (FYROM) en EUJUST THEMIS in Georgië; is voorts ingenomen met de komende stationering van een politiemacht van de Europese Unie in de Democratische Republiek Congo (EUPOL Kinshasa);

E. acknowledging that the comprehensive approach advocated in the European Security Strategy is already being actively pursued in the Balkans, as demonstrated by the scale of EU instruments currently being applied to bring stability to the region: the CARDS assistance programme; the civilian missions PROXIMA and EUPM; and the military mission ALTHEA,

Article 13 of the Joint Action provides that the status of EUPOL 'Proxima' staff in the Former Yugoslav Republic of Macedonia, including where appropriate the privileges, immunities and further guarantees necessary for the completion and smooth functioning of EUPOL 'Proxima' shall be agreed in accordance with the procedure laid down in Article 24 of the Treaty on European Union.
Artikel 13 van dat Gemeenschappelijk Optreden bepaalt dat over de status van het EUPOL "Proxima"-personeel in de Voormalige Joegoslavische Republiek Macedonië, in voorkomend geval inclusief de voorrechten en immuniteiten en overige waarborgen die nodig zijn voor de uitvoering en de soepele werking van EUPOL "Proxima", overeenstemming wordt bereikt volgens de procedure van artikel 24 van het Verdrag betreffende de Europese Unie.

65. Has decided, in accordance with Article 39.1 of the IIA of 6 May 1999, to enter Common Foreign and Security Policy (CFSP) appropriations at a similar level to the 2003 budget pending the receipt of further information from the Council on, in particular, the non-programmed appropriations and a commitment from the Council to transmit, from now on, a separate and qualitatively improved document containing its priorities and their financial implications for the following year; urges the Council to make proposals to improve the early-warning system and the political dialogue with Parliament on CFSP actions, as agreed in the Joint Declaration issued on 25 November 2002 by the Council, the Commission and Parliament in the context of the 2003 budgetary procedure; has provided for some appropriations for the new EU Police Mission (Proxima) in FYROM; before taking a final decision on the budgetary provisions for this Police Mission, Parliament expects the Council, prior to the conclusion of its legislative procedure, to fully consult with Parliament as laid down in the abovementioned agreement;
65. heeft besloten om overeenkomstig paragraaf 39, lid 1 van het Interinstitutioneel Akkoord van 6 mei 1999 en hangende aanvullende informatie van de Raad over in het bijzonder de niet-toegewezen kredieten en een toezegging van de Raad om vanaf nu een apart en kwalitatief hoogwaardiger document voor te leggen met daarin zijn prioriteiten en hun financiële gevolgen voor het volgend jaar, in de begroting 2004 voor het gemeenschappelijk buitenlands en veiligheidsbeleid (GBVB) een vergelijkbaar bedrag op te nemen als in de begroting 2003; spoort de Raad met klem aan voorstellen voor te leggen voor het verbeteren van het systeem van vroegtijdige waarschuwing en de politieke dialoog met het Parlement over GBVB-acties, zoals overeengekomen in de door de Raad, de Commissie en het Parlement op 25 november 2002 in het kader van de begrotingsprocedure 2003 goedgekeurde gemeenschappelijke verklaring; heeft kredieten opgenomen voor de nieuwe politiemissie (Proxima) van de EU in FYROM; wacht met het nemen van een definitieve beslissing over de begrotingsaspecten van deze politiemissie tot het door de Raad in het kader van de wetgevingsprocedure is geraadpleegd, zoals vastgelegd in het hierboven vermelde akkoord;
