1. If a Member State which has granted EU type-approval as provided for in Article 8 finds that any vehicle units, motion sensors, record sheets or tachograph cards bearing the EU type-approval mark issued by it do not conform to the prototype which it has approved, it shall take the necessary measures to ensure that production models conform to the approved prototype. The measures taken may, if necessary, extend to withdrawal of EU type approval.

If, in a particular application for type approval for an on-board sewage treatment plant type, the competent authority finds that the application submitted with regard to the presented plant prototype is not representative of the characteristics of this type of on-board sewage treatment plant as described in Appendix VI, Part II, Addendum I another, if necessary additional, prototype, to be designated by the competent authority, shall be supplied for approval in accordance with paragraph 1.

The development of commercially usable prototypes and pilot projects is also included where the prototype is necessarily the final commercial product and where it is too expensive to produce for it to be used only for demonstration and validation purposes.
