This Convention was amended by an Agreement concluded in Luxembourg on 15 December 1989 concerning Community patents and including, amongst other things, the Protocol on the Settlement of Litigation concerning the Infringement and Validity of Community Patents.

The import of the protocol is to constrain the practice of the courts in deploying the Charter during their domestic litigation, which is something far inferior and peripheral – and, at the end of the saga, negligible.
