In order to avoid the possible fragmentation of the internal market due to divergent selection criteria and procedures for harmonised spectrum allocated to electronic communication services and made tradable in all Member States pursuant to Article 9b of Directive 2002/21/EC, the Commission shall, in cooperation with Member States and in accordance with the principle of subsidiarity, facilitate the identification and sharing of best practices on authorisation conditions and procedures and encourage sharing of information for such spectrum to increase consistency across the Union, achieved in line with the principles of technology and service neutrality.

(43) In line with the objectives of the regulatory framework for electronic communications networks and services and with the principles of proportionality and subsidiarity, and for the purposes of legal certainty and efficiency for European businesses and national regulatory authorities alike, this Directive focuses on electronic communications services, that is services normally provided for remuneration and consisting wholly or mainly in the transmission of signals on electronic communications networks, if those services are available to the public, and therefore does not apply to services made available to limited groups of identifiable individuals such as closed user groups and corporate networks.

The providers of publicly available electronic communications services should inform their subscribers of the existence of calling and connected line identification in the network and of all services which are offered on the basis of calling and connected line identification as well as the privacy options which are available.

This text, which complements Chapter V of the "television without frontiers" Directive on the protection of minors, is the first Community legal instrument covering all the electronic media, including the content of on-line audiovisual and information services transmitted via the Internet.
