The decision should contain a negotiating mandate. Defining too strictly in the Rules the form of such a mandate would be counter-productive in terms of flexibility and efficiency.

The Commission subsequently proposed a negotiating mandate (June 2006). Not one, but two negotiating mandates were then given to the Commission by the Council (November 2006): one related to amending the agreement on the basis of Article 106(1) (amendment clause), allowing the Council to adopt any amendment proposed by any party to the agreement; the other allowed bilateral negotiations to be opened on revising the provisions of the agreement with regard to its political dimension and matters concerning justice, freedom and security.

In section 1, which concerns the Bali negotiating mandate, there is a misunderstanding in the Finnish, which suggests that this resolution would be dealing with the EU’s internal negotiating mandate before the Bali Conference. In fact, the Bali mandate means that at the Bali Conference the countries which have ratified the climate treaty will try to obtain a negotiating mandate to make it possible to establish the next climate treaty.
In artikel 1, dat gaat over het onderhandelingsmandaat van Bali, is er in het Fins een misverstand. (15) In accordance with the negotiating mandate given to the Commission by the Council, during the forthcoming World Trade Organisation (WTO) negotiations the Union should ensure, as in the Uruguay Round, that the Community and its Member States maintain the possibility to preserve and develop their capacity to define and implement their cultural and audiovisual policies for the purpose of preserving their cultural diversity.
(15) Conform het door de Raad aan de Commissie verleende onderhandelingsmandaat zal de Unie tijdens de komende WTO-onderhandelingen er evenals in de Uruguayronde op toezien dat de Gemeenschap en haar lidstaten de mogelijkheid blijven behouden om hun culturele en audiovisuele beleid met het oog op het behoud van hun culturele verscheidenheid uit te stippelen en uit te voeren.
