4. To the extent permitted by the Protocol, the Commission may, in agreement with both the competent authority of the Member State in which a producer’s relevant production is situated and the government of the third country Party concerned, authorise a producer to combine the calculated levels of production laid down in Article 10 and Article 11(2) with the calculated levels of production allowed to a producer in a third country Party under the Protocol and that producer’s national legislation for the purpose of industrial rationalisation with a third country Party, provided that the combined calculated levels of production by the two producers do not exceed the sum of the calculated levels of production allowed to the Community producer under Article 10 and Article 11(2) and the calculated levels of production allowed to the third country Party producer under the Protocol and any relevant national legislation.
4. Those requirements are consequently reflected in national product standards, national technical approvals and other national technical specifications and provisions related to construction products. By their disparity, those requirements hinder trade within the Community.

For the sake of consistency with Community legislation in other fields, in the case of plant and livestock production, Member States should be allowed to apply within their own territories, national production rules which are stricter than the Community organic production rules, provided that these national rules also apply to non-organic production and are otherwise in conformity with Community law.
Omwille van de samenhang met communautaire wetgeving op andere gebieden dient het de lidstaten toegestaan te zijn om in het geval van plantaardige en dierlijke productie op hun grondgebied nationale productievoorschriften toe te passen die strenger zijn dan de communautaire voorschriften voor biologische productie, mits die nationale voorschriften ook gelden voor de niet-biologische productie en in overeenstemming zijn met het Gemeenschapsrecht.

5. brengt in herinnering dat de verdeling van Gemeenschapsgelden van andere landbouwsectoren die in het kader van het nieuwe GLB zijn hervormd door het opzetten van "nationale totaalbedragen" is geschied op basis van de gehele of gedeeltelijke loskoppeling van de communautaire subsidies; benadrukt dat de nieuwe GMO voor de wijnsector moet worden gebaseerd op homogene maatregelen die voor alle lidstaten gelden en op maatregelen in het kader van het subsidiariteitsbeginsel waarbij rekening wordt gehouden met de specifieke behoeften van de sector in elke lidstaat of productieregio; meent tevens dat de sector (productie, handel, interprofessionele organisaties, productieregio's) in elke lidstaat in samenwerking met de regionale en nationale instanties door middel van een reeks programma's moet bepalen hoe de doelstelling van de aanpassing van de productie aan de markt het best kan worden verwezenlijkt, gebruikmakend van een of meer van de in het kader van de nationale totaalbedragen vastgelegde maatregelen; meent dat de maatregelen in het kader van de subsidiariteit op Europees niveau moeten worden vastgesteld en begeleid om concurrentieverstoring te voorkomen en volledige financiering uit de communautaire begroting mogelijk te maken;

In the case of imports of organic products from third countries, the competent national and European authorities should take account of the fact that the statutory general conditions in producer countries differ from those in the EU. Farmers in third-countries are sometimes operating within different structures and documentation requirements in many third countries are not as developed as in the EU. Irregularities can occur at some distance from the place of production at loading yards, ports and interim storage facilities.
