TRADUCTIONS EN CONTEXTE

1. In order to prevent the provision of financial services or the transfer to, through, or from the territory of Member States, or to or by nationals of Member States or entities organised under their laws, or persons or financial institutions within their jurisdiction, of any financial or other assets or resources, including bulk cash, that could contribute to the DPRK's nuclear-related, ballistic missile-related or other weapons of mass destruction-related programmes or activities, or other activities prohibited by UNSCR 1718 (2006), 1874 (2009), 2087 (2013) or 2094 (2013) or by this Decision, or to the evasion of measures imposed by those Resolutions or by this Decision, Member States shall exercise enhanced monitoring, in accordance with their national authorities and legislation, of the activities of financial institutions within their jurisdiction with:
1. Takes the view that chief risk officers should have the same status in a financial institution as the chief financial officer and should be able to report directly to the board; considers that a risk committee should be established at board level to deal with risk issues and monitor correct implementation of the risk strategy throughout the financial institution; calls for the introduction of European standards governing the qualifications of chief risk officers and members of risk committees, with a view to enhancing their status within financial institutions;

Considers that the economic and financial governance structures in place at the onset of the crisis, whether at global level, in the USA or within the European Union, lacked coherence and consistency in separating macro- from micro-prudential supervision, focussed excessively on bottom-up micro-prudential supervision of financial institutions and country-level monitoring of macroeconomic indicators, whilst neglecting the system-wide view of the financial and macroeconomic developments that would necessitate monitoring of the interconnectedness among financial institutions and among countries;

call on Member States to closely monitor financial institutions and fund transfer services in order to identify suspicious fund transfer activities in which transfers are not supported by the full name, address and account number of the (natural or legal) person requesting the transfer of funds;

Where the criteria in the first subparagraph are met, each EU investment firm shall have in place systems to monitor and control the sources of capital and funding of all financial holding companies, investment firms, financial institutions, asset management companies and ancillary services undertakings within the group.
